ORDINANCE NO. 1826 BY Mrs. Waitt AN ORDINANCE to provide for the Construction of sewer and w~ter connections of vitrified sewer pipe and lead wmt~r pipe respectively, in Overbrook Avenue from Riverway Avenue to Indiancla Avenue and levying and assessing a special tax to pay the cost and expense thereof, and authorizing the Mayor and Director of Finance to issue notes in the sum of $1',100,00, in anticipation of the collection 0f said special tax to provide a fund for the payment of the portion cf t~e cost and expense cf maid improvement for which said special tax is levied. ~[EREAS, the Director of Public Works of the City of Lakewood, in view of contempalted street improvements and as a sanitary regulation has deemed it necess~ry and conducive to the public health, convenience, or welfare, and has determined that sewer anti water connections shall be constructed in Overbrook Avenue from Riverway Avenue to Indianola Avenue. and ' ~H~R~S, said Director of Public ~orks has caused written notice of his determination thereof to be given to the owner of each lot or parcel of land to which such connections are to be made, which notice stated the number ~nd character of connections required, and w~s served by a person designated by the Director of Public Works in the manner provided for the service or s,~m~ons Xn civil actions, and non-residents of the City, cr persons who could not ~e found were served by publication once in a newspaper of general circulation in the municipality, which notice stated the time within which su0h~eonneotions should be made. to-wit; thirty days after delivery thereof, and ~HEREAS, a large number of ~aid 'connections have not been constructed within the time stated, and it is necessary that said connections be made without delay, and the cost of said connections has been estimated by the Director of Public Works as $1.100.00, and Wt~Ri~AS, an emeegency exists for the immediate preservation of the public health, property and safety, arising out of the nece~eity of the construc- tio~ of said connections withou~ delay. NOW', THER.~OH~,; B~ IT ORDAINED By the Council of the City of Lakewood, State of Ohio, three-fourths of all me~bers thereof ~oncurrtng: Section 1: T~t in view of the facts aetforth in the foregoing preamble, the Director of Public Wcrk~ be, and he i~ hereby authorized, and directed to enter into contract in the m~ane~rovided by law to make and h~ve made sewer ~nd w~ter connections, of vitrified sewer pipe ~nd lead water pipe respectively, in Overbrcek Avenue from Rlve~vay ^venue to Inidanola Avenue in accordance with plans, specifications and estimates on file in the office of the Director of Public Works and the notice~ and proceedings heretofore given and h~d pertaining to said sewer and w~,ter connections, and s~id pl~n~, ~peoifications, estimates, notices and proceedings ~re hereby approved. Section 2: That for the purpose of paying the cost cf said connections there shall be ~nd there is hereby levied andaeSessed a apeci~l tax UpOn the several iota an~ parcels of land for which Connections are marde. Said assessment s~ll be certified and collected as other assessments for street improvements, Section ~: Th~;t the owners of the several lots and oarcels of land so assessed shall pay the amounts from them severally d~e as shown by the report of s~id Director of ~blic Works, to the Director of Finance on or before th~$y days from the date of the passage of this ordinance, at their option and in default thereof said special aeses~:~ment, with interest at the rate of not to exceed six per cent (6%) per annum, upon deferred payments, abel! be payable to the County Treasurer in two equal inst~llments with the regular taxes of 1922 ~nd 192~.
