ORDI~ANCE N0.1830 By Mrs. Waitt AN ORDINANCE determining to proceed with, and levying and assessin~ ~ special tax to pay the co~'t and expense of improving Arden Avenue from Alger Road to Andmar Avenue by paving same with brick or bituminous con- crete or sheet asphalt, orcement concrete, doing any and all grading, drain- ing and curbing and installing necessary curb connections, and authorizing the Mayor and Director of'Finance to issue bonds in the sum of'$10,6~0.00 in anticipation of said special tax to provide a fund to pay the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring: Section 1: That it is hereby determined ~o.proceed wi~h the improve- ment of Arden Avenue from Alger Road to AnG~ar~Avenue oy pavinE same with brick or bituminous concrete or sheet' asphalt, or cement concrete, doing any and all grading,, draining and curbing and installing necessary curb connections, · ~ in accordance with Resolution No, 1912 passed June 20¥ 1921 a~d in accordance with plans, specifications~, estimates and profiles her6~ tofore approved and now on file In the office of the Director of Pub~.ic Works. Section 2: That all claims for damages resulting from said improve- ment shall be judicially inquired into after the completion thereof, and that the Director of Public ~orks be and he is hereby authorized and directed to enter into contract for said improvement in the manner provided by law, which improvement, in accordance with Article Section 16 of the Charter has been estimated by the Director of Public Works to have a life of 20 years~ Section ~:~ That for the purpose ol'~paying the cost and expense of said improvement there is hereby levzed and assessed a specmal tax upon the several lots and parcels o~ l~nd designated in and ~n accordance with E~timamsd Assessmen~ No.$8$~Pas made for that purpose by the Director of Financ~ and recommended to this Council by the Board of Revision of Assessments. Said estimated assessment was made on the basis of special benefits conferred by samd improvement on the several parcels of land therein described' and the same is herein.confirmed adopted and approved~ ' Section %: That the owners of the several lots or parcels of land i.n- clUded in said assessment sh~ll pay the amounts from them severally due as shown by Column No. ~ of said Esti~te~l Assessment No~ 48$~o the City Treasurer on or.before thirty days from ~he dat'e of the passage of this ordinance, a~ their option, and in default thereof said special assessment with interest a~ the ra~e of 6 per centum per annum,, upon deferred p~yments, shall be payable to the County Treasurer in l0 annual installment~s with the regular taxes of 1922 to 19~l both inclusive. Section ~: That to provide a fund for the B'~,'~y~nt .~ the portiion of the cost and expense for which the special s, sses~?.e~t herein is levied for said improvement, The ~ayor and Director of ~n~noe~' ~ be and they" are hereby authorized to issue l0 bonds of the City of Lakewood, Ohio in the aggregate sum of $10,6~0.00 of which bonds one bond in the sum of $1,06~.00 shall be due and payable on October 1,~192~ and one bond in the sum of $1,06~.00
