ORDI!~ANCE NO. 1831 By Mrs. Knirk AN ORDINANCE determining to proceed with, and levying and assessin~ s special tax to pay the cost and expense of improving Concord Drive ~from Riverway Avenue to Delaware Avenue by paving same with brick or bituminous concrete or sheet asphalt, or cement Concrete, doing any and all grading, draining and curbing incidental and necessary thereto, and m~horizing the Mayor and Director of Finance to issue bonds in the sum of ~18~570.00 in anticipation of said special tax to provide a fund to pay the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the Qity of Lakewood, State of Ohio, three-fourths of all members thereof concurring: ~ection l: That it is hereby determinsd to proceed with the improve- ment of ConcOrd Drive from RiverWay Avenue to Delaware Avenue bY paving same with brick or bituminous concrete or sheet asphalt, or cement concrete, doing any and all grading, 'draining and curbing incidental and necessary thereto, a~ ~'?t~ in accordance with Resolution No. 1927 passed August l, 1921 and in accordance with plans, specifications, estimates and profiles here- tofore approved and now on file in the office of the Director of Pu¥1i: Works. Section 2: That all claims for damages resulting from said improve- ment shall be judicially inquired into after the completion thereof, and that the Director of Public V~'Crks be and he is hereby authorized and directed to enter into c~ntraCt for said improvement in the mann.e.~: provided b.y law, which improvement, in accordance With Article Section 16 of the Charter'has been estimated by the Director of Public Works to have a life of 20 years. Section 3: That for the purpose o~paying the Cost and expense of said improvement there is hereby %evied and assessed a special tax upon th~ several lots and parcels of land designated in and in accordance with Estimated AsSessment No. 483 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revisior of Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and.the same is herein confirmed, adopted and approved. Section ~: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them seVerally~ due aS shown by Column No. ~ of said Esti~.te~d AsseSsment N0,~83 to t~.~e City Treasurer on or before thirty days fro~ %he date of the passage ~ this ordinance, at their option, and in default thereof said special assessment with interest at the rate of 6 per centum per annUm, upon deferred payments, shall be payable to the County Treasurer in l0 annual installments with the regular taxes of 1922 to 1931 both inclusive, Section 5: That to provide a fund for the ~K~y~at ~'.the portiion of the cost and expense for which the special assesc..~ent herein is levied for said improvement, The ~,~ayor and Director of Finance be and they are hereby authorized to issue l0 bonds of the City of Lakewcod, Ohio in sth~ aggregate sum of $18,570.00 of which bonds one bond in the s%~m of 1,557.00 shall be d~e and payable on October l, 1923 and one bond in the sum cf $1,8~7.00
