ORDI!~ANCE N0~ 1833 By Mr, ~ormsen AN 0RDINA~CE determining to proceed wi{h, and levying and assessin~ s special tax to pay the cost and exoense of improving Elbur Avenue from Clifton Boulevard to Merle Avenue Sy paving same with brick or bituminous concrete or sheet asphalt, or cement concrete, doing any and all grading, draining, curbingand constructing curb connections necessary and incidental thereto, and authorizing the Nayor and D~rector of Financeto issue bonds in the sum of $i7,470.00 in anticipation of said special tax to provide a fund to pay the portion of the cost andexpense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood. State of Ohio, three-fourths of all members thereof concurring: Section l: That it is hereby determined to proceed with the improve- ment of Elbur Avenue from Clifton Boulevard to Merle Avenue by paving same with brick or bituminous concrete or sheet asphalt, or cemen~concrete doing any and all grading, draining curbing and constructing curb connec- tions necessary and incidental thereto. in accordance with Resolution No, 19~8 passed January 16,1922 amd in acoorda, nce with plans, specifications, estimates and profiles here- tofore approved and now on file in the office of the Director of Public Works. Section 2: That alt claims for damages resulting from said improve- ment shall be judicially inquired trite after the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner ~rovided by law, which improvement, in accordance with Article ~ection 16 of the Charter'has been estimated by the Director of Public Works to have a life of 20 years. Section 3: That for the purpose oi'~paying the cost and expense of said improvement there is hereby lev~ed and assessed a special tax upon the several lots and parcels of land designated in and in accordance with Estimated Assessmenz No. 488 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved. Section ~: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No. 3 of said Estimste~d Assessment No, 488 to the City Treasurer on or before thirty days fro~ ~he date of the passage of this ordinance, at their option, and in def. ault thereof said special assessment with interest at the rave of~ per centum per annum, upon deferred payments, shall be payable to the County Treasurer in l0 annual insta%lments with the regular taxes of 1922 to 1931 both inclusive, Section ~: That to provide a fund for the ~;y~gnt .,'~ the portiion of ~he cost and expense for which the special a, ssesc.~ent herein is levied for said improvement, The ~,gayor and Director of Finsnce be and they are hereby authorized to issue lO bonds of the City of Lakewood, Ohio in the aggregate sum of $17,470.00 of which bonds one bond in the sum of $1,747.00 shall be due and payable on October l, I923 and one bond in tSe sum of $1,747.00
