AN ORDI!~ANCE NO, 1836 By Mr. Har~ ORDINANCE determining to proceed with, and levying and assessin~~ e special tax to pay the cost and exDense of improving Niagara Drive from Hilliard Road to Lakewood Heights ~oulevard ~yhpaving same wit~ brick or bituminous concrete, or Sheet asphalt or cement concrete, doing any and all grading, draining and curbing, incidental and necessary thereto, and authorizing the Mayor and ~irector ~f Finance to issue bonds in the sum of $18,760.00 in anticipation of said special tax to provide a fund to pay the portion of the cost and expense cf said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring; Section t: That it is hereby determined to proceed with the improve- ment cf Niagara Drive from Hilliard Road to Lakewood Heights Boulevard by paving same with brick or bituminous concrete, or sheet asphalt or cement concrete, doing any and all grading, draining and curbing, in- cidental and necessary thereto. in accordance with Resolution No, t886 passedEarch 21, 1921 and in accordance w~th plans, specifiGations, estim@tes and profiles her6- tofore approved and now on file in the office of the Director of Public ~orks. Section 2: That all claims for damages resulting from said improve- ment shall be judicially inquired into after ~he completion thereof, and that the Director of Public ~orks be and he is hereby authorized and directed %o enter into contract for said improvement in the manner provided by law, which improvement, in accordance with Article 15, Section 16 of the Charter has been estimated by the Director of Public Works to have a life of 20 years. Section 3: That for the purpose oftpaying the cost and'expense of said improvement there is hereby levied and assessed a speczal tax upon the several lots and parcels of land designs;ted in and in accordance with Estimated Assessment No. 482 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision . of Assessments. Said estimated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed~ adopted and approved, Section ~: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by C6Iumn No. 3 of said Esti~te.d Assessment No,482 to the ~ity Treasurer on or before thirty days from {he date of the passage of this ordinance,'at their option~ ~nd in default thereof s~'id special assessment with interest at the rate of 6 per centum per annum, upon deferred payments, shall be payable to the County Treasurer in l0 . annual installments with the regular ~axes of 1922 to 1931 both inclusive. Section ~: That to provide a fund for the W~,'~M~t .~ the ~ortiion of the cost and expense for which the special assesz..~e~t here~n is levied for said improvement, The l~ayor and Director of Finsnce be and they are hereby authorized 'ta ~seue l0 bonds of the City of Lakewood, Ohio in th~ ~ggregate.sum of $18,760.00 of which bonds one bond in the sum of $1,676.00 shall be due and payable October l, 1923 and one bond in the sum or $1,876.00
