ORDI!~ANCE NO. 1841 By Mr. Hart AN ORDINANCE determining to proceed with, and levying and assessin~ a special tax to pay the cost and expense of improving Brown Road from Madison Avenue to Fischer Road by paving same wi'th brick or bituminous concrete or sheet asphalt, or asphalt block, or bitulithic, or cement concrete, doing any and all grading, draining and curbing and constructing curb connections incidental and necessary thereto, and authorizing the Mayor and Director of Finance to issUe bonds in the sum of $38,29~.00 in antici- pation of said special tax to provide a fund to pay the portion of the cost and expense of said improvement for which said special tax.is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof concurring: Section 1: That it i~ hereby determined to proceed With the improve- ment of Brown Road fromMadison Avenue to Fischer Road by paving same with brick or bituminous concrete, or sheet asphalt, or asphalt block, or bitulithic, or cement concrete, doing any and all grading, draining and curbing and constructing curb connections incidental and necessary thereto. in accordance with Resolution No, 1970 passed March 6, 1922 and in accordanoe with plans, specifications, estimates and profiles here- tofore approved and now on file ~n the office of the Director of PUblic Works. Section 2: That all claims for damages resulting from said improve-' ment shall be judicially inquired into after the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner provided by law, which improvement, in accordance wi~h Article 15, Section 16 of the Charter has been estimated by the D.irector of Public Works to have a life of 20 years, Section 3: That for the purpose 5f~paying the cost and expense of said · mprovement there is hereby levied and assessed a specmal tax upon ~he several lots and parcels of land des~gns~ted in and in accordance with Estimated Assessment No. $93 as made for that purpose by the Director of Financs and recommended to this Council by the Board of Revision of Assessments. Said estmmated assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved, Section $:: That the owners of the several lots or parcels of land in- cluded in said assessment shall pay the amounts from them severally due as shown by Column No, 3 of said Estims, te~ Assessment No. ~93 to the City Treasurer on or before thirty days fro~ ~he date of the pasmage this ordinance, at their option, and in default thereof said special assessment with interest at the rate of ~ per centum per annum, upon deferred payments, shall be payable to the County Treasurer in annual installments with the regular taxes of 1922 to 1930 both inclusive, . ~'~'.~ ,~ the oortiion of Section ~: That to provide a fund for the ~,., the cost and expense for w,hich the special a, ssesc,.~e~t herein ia levied ~mn~nce be and t~ey are for said improvement, The ~a~or and Director of hereby authormzed to issue ~ bonds of the City of Lakewood,.
