ORDI!~ANCE NO. 1872 By Mrs. Knirk AN ORDINANCE determining to proceed with, and levying and assessin~ s special tax to pay the cost and exoenseoof improving Maile Avenue from Detroit Avenue to Owego Court by p~ving same withbrick or bituminous con- crete, or Sheet asphalt or asphalt block or bitulithic, or cement concrete, doing any and all grading, draining and cUrbing and constructing curb connections incidental and necessary thereto and authorizing the Mayor and Director of Finance to issue bonds in the sum of $7,130.00 in antici- pation of said special t~x to provide a fund to pay the portion of the cost and expense of said improVement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three-fourths of all members thereof ooncurring~ Section 1: That it is hereby determined to proceed with the improve- ment of Maile Avenue from Detroit Avenue to Owego Court by paving~smme with brick or bituminous concrete, or sheet asphalt or asphalt block or bitulithic, or cement concrete, doing any ~nd all grading, draining and curbing and constructing curb connections incidental and necessary thereto in accordance with Resolution No. !9%7 passed Jan. 16th, 1922 and in accordance with plans, specifications, estimstes and profiles here- tofore approved and now on file in the office of the Director of Publio We rks. Sec'tion 2: , That all. claims for damagea resulting from said improve- ment shall ce judicially inquired into after the completion thereof, and that the Director of Public Works he and he is hereby authorized and directed to enter into contract fo~ said improvement in the manner provided b~y law, which improvement, in accordance with Article l~, Section 16 of the Charter has been estmmated by the Director of Public Works to have a life of 20 years. Section 3: That for the purpose oi,,paymng the cost and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of land designated in ~nd in accordance with Estimated Assessment No. ~01 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments~ Said estims, ted assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is here~n confirmed, adopted and 'approved. Section $: That the owners of the several lots or parcels of land in- eluded in said assessment shall pay the amounts from them severally~ due as shown by Column No. ~ of said Estir~tezi Assessment No. ~01 to the City Treasurer on or before thirty days fro~ ~he date of the passage of this ~rdinance, at their option, and in d'ef~ult thereof ss.id special assessment with interest at the rate of ~per centum per annum, upon deferre~ payments, shall be payable to the County Treasurer in l0 annual installments with th~ regular taxes of 1922 to 19~l both inclusive.
