0RDI~ANCE NO. 1885 BY Ers. Knirk ~.N ORDINANCE determining to proceed with. and levying and assess~g ~pecial tax to pay the cost and expense of improving Esther Avenue fromm. Alger Ro~d to Ears (And~r) Avenue by constructing sewer main of ~itrifled sewer pipe therein with necessary mamholes, c~tch-b~sins, c~rb connections and other appurtenances incidental thereto, and authorizing the Eayor and Director of Finance to issue bonds in the su~ o£ $~,940.00 in anticipation of the collection of said special tax to proVide a fund for the pavement of the portion of the cost and expense of said improvement for which said Special t~x is levied. BE I~ ORDAINED by the Council of the. City of Lakeweod, State o.f Ohio, thre~e~fourths of all members thereof concurring: Section 1: That it is hereby determined to proceed with the improve- menthol ESther Avenue from Alger Ro~d to ~oms (Andmar)Avenue by construct- ing sewer main of vitrified sewer pipe therein with necess~ry manholes, catch,bmsins, curb connections and other appurtenances incidental thereto. in accordance with Resolution,No. 200? passed April 24, 1922 and in accordance with plans, specifications, estims, tes and profiles here- tofore approved and now on file in the office of the Director cf Public Works~ Section 2! That all claims for damages resulting from said improve- ment shall Be judicially inquired into after the completion thereof, and that the Directo~ of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner ~erovlded ~y law. which improvement, in accordance with Article 15, ction 16 of the Charter'has been estimated hy the Director of Publxc Works to have a life of 20 years. Section 3: That for the purpose oi',paying the cost and expense of said improvement there is hereby levied and assessed a special ts~x upon the several lots and parcels of land design~ted in and in accordance with Estimated Assessment No. ~06 as made for that purpose by the Director cf Finance and re6ommended to this Council by the Board of Revision ~f Assessments. Said estimated assessment was made on the basis of special benefits csnferred by said improvement on the several parcels of land therein described and the s~e is herein confirmed, adopted and approved, Section $: That the owners of the several l~ts or parcels of land in- cluded in said assessment Shall paM the amounts from them severally ~? a~ shown ~y Column N@~ ] cf said Estin~te~i Assessment No. 506 to the ~%Y Treasurer on or before thirty days from {he date of the passage of this ordinsnce, at their option, and in def. mult thereof said special assessment with interest at the rate of ~per centum per annum, upon deferred payments, shall be payable~to the County Treasurer in ~ annual installments with the regular taxes of 1922 to 1926 botL inclusive, Section %: That to provide a fund for the ~w~y!~nt ,~the portiion of the cost and expense for which the special s,~ses~,.~ent herein is levied for said improvement, The ~ayor and Director of Finance be snd they a~~. hereby authorized to issue ~ bonds of the City of Lzkewooa, Ohio in the aggregate sum of $$,9~0.00 of which bonds one bond in the sum of $988.00 Shall be due and pDyable on October l, 1923 and one bond in the s~ o~ $988.00
