Gormsen ~ ORDINANCE determining to proceed with, and levying and assess~.~ ~pecial tax to pay the cost and expense of improving LanninE Avenu~ from Andmar Avenue to Alger Road By constructing sewer main of vitrified sewer pipe therein, with necessary manholes, cs.tch-basins, ~curb Connections and other appurtenances incidental thereto, and authorizing the 5~ayor and Director of Fit~nce to issue bonds in the sum of ~A,94~.00 in anticipation of the collection of said special tax to provide a fund for the payment of the portion of the cost and expense of said improvement for which said special tax is levied. BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, thre~-fourthe of all members thereof ~0ncurring! Section ~: That it is hereby determined to proceed with the improve- ment of Lanning AVenue from Andmar Avenue to Alger Road by constructing sewer main of vitrified sewer pipe therein,wAth necesss~ry manholes, catch-basins, curb connections and other appurtenances i omdental thereto. ~ ' in accordance with Resolution No~ 1992 passed April 3, 1922 and in accordance with plans, specifications, estims, tes and profiles here- tofore approved and now on file in the office of the Director of Public Works~ Section 2: That all claims for damages resulting from said improve~ ment shall be judicially inquired into after the completion thereof, and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner provided ~y law, Which improVement, in accordance with Article Section 16 of the Charter has been estimated by the Director of Public Works to hsve a life of 20 years~ Section 3: That for the purpose cz paying the cost and expense of said improvemen~ there is hereby levied and assessed a special tax upon the several lots and parcels of land deeignsted in and in accordance with Estimated Assessment No. ~05 as made for that purpose by the Director of Finance and recommended to this Council bY the Board of Revision ~f Assessments~ ~aid estims, ted assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved, Section 4: That the owners of the several l~ts or parcels of land in,- clUded in said assessment Shall pay the amounts from them severally due as shown by Column No, 3 of said Estimate~ Assessment No~ ~09 to the City Treasurer on or before thirty days from {he date of the passage of this ~rdinance, at their option, and in default thereof Said special assessment with interest at the rate of ~09Per centum per annum, upon deferred payments,, shall be payable to the County TreasUrer in ~ annual installments with the regular taxes of 1922 to 192~ botL inclusive.
