Hart '-~ ORDINANCE determining to proceed with, and levying and assessi~ ~reCial tax to pay the cost and expense of impr0ving Lanning Avenu~ om Andmar Avehue to Alger Road by l~y~ng' ~ water m~in of six inch cgst iron pipe therein, With necessary valves, hydrants, snd other s~ppurten~,nces incidental thereto, and ~uthorizing the H~yor ~nd Director of Finance to isshe bonds in the sum of $2,1~.00 in ~nticipation of the collection of said special tax to provide a fund for the D~yment of the portion of the cost and expense of said improvement for which said special BE iT ORDAINED by the Council of the City sf Lakewocd~ State of Ohio, three-fourths of all members thereof concurring: . Section l: That it is hereby determined to proceed with the improve- ment cf Lanning Avenue from Andmar Avenue to Alger Road by l~ying water main therein with necessary valves, hydrants, and other appurtenances incidental thereto. ~n ~ccOrdance with ResolUtion No. ~ 199~ passed April ~, 1~22 and in accordance With pla~s, specifications, estimstes and profiles here- tofore approVed and now on fite in the office cf the Director cf Public Works. S~etion 2: That all claims fer damages resulting from said improve- ~ ment shall be judicially inquired into after the completion thereof, and that the Directo~ of Public Works be and he is hereby authorized and directed to enter into contract for s~id improvement in the manner ~ro~ded~y law, which improvement, in accordance with ArtiCle 15~ ec~on lo of the Charter~has been estimated bY the Director cf Public Works to have a life of 20 years, Section ~: That for the purpose e~~ paying the cost and expense of said improvement there is hereby levied and assessed ~ special t~x upon the several lots and parcels of land designated in and in accordance with Estimated Assessment No.~08 as made for that purpose by the Director cf Finance and recommended to this Council by the Board of Revision ~f Assessments. ~aid estimated assessment was made on the basis o~ special benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved. ~ Section ~: That the owners of the several l~ts or parcels of land in~. eluded in.said assessment shall pay the amounts from them severally due as shown by Cslumn No. ~ cf said Estir~te~ Assessment No.~08 to the City'Treasurer on or before thirty days fro~ ~he date of the passage of this ordinsnce, at their o~tion, and in default thereof said special assessment with interest at the rate of ~ per centum per annum, upon deferred payments, ~all be payable to the County Treasurer in annual installments with the regular taxes of 1922 to 1926 bot~ ~nclusiveo Section ~: That to provide a fund for the r.>~,~t ~.~'~ the portiion of the cost and expense for which the special g~sesc~ent herein is levie~ for said improvement~ The ~ayor s~nd Director of Pinance be snd they hereby authorized to issue ~ bonds ef the City of Lakewooa, Ohio in the aggregate s~ of $2,1~.00 of which bo~s?~ne bond in the s~ of $~1.00 shall be due ~nd p~y~ble on October l, 1~2~ ~ndone bond in the ~31 · O0
