ORDI~ANCE N0.1888 ByErs. V~itt <br />'~ ORDINANCE determining to proceed with, and levying and assess~ <br />~pecial tax to pay the cost and expense of improving Blossom Park ~venue <br />from Detroit Avenue to Cedarwood Avenue by paving same with brick or <br />b~tuminous concrete, or sheet asphalt, or bitulithic, or cement concrete, <br />doing any and all grading, draining and curbing incidental and necessary <br />~hereto, and authorizing the Mayor and Director of Finance to issue bonds <br />in the sum of $39,978.00 in anticipation of the collection of said special <br />tax to provide a fund for the payment of the portion of the cost and <br />expense of said improvement for which said special tax is levied. <br /> <br />BE tT'0RDAINED by the COuncil of the City of Lakewood, State of Ohio, <br />three-fourths of all members thereof concurring: <br /> <br />section.l: 'That it is hereby determined to proceed with the 'improve- <br />ment of Blossom Park Avenue from Detromt AvenSe to Cedarwood Avehue by <br />paving same with brick ~r bit~ninous concrete, or sheet asphalt, or <br />bitulithic, or cement concrete, doing any and all grading, draining <br />and curbing incidental and necessary thereto <br /> <br />in accordance with Resolution No. '1987 passed April 3, 1922 and <br />in accordance with plans~ specifica~ions, estimates and profiles here- <br />tofore approved and now on file in the office of the Director of Public <br />Works,' <br /> <br />Section 2: That all claims for damages resulting from said improve~ <br />ment shall be judicially inquired into after the completion thereof, <br />and that the Director~of PUblic Works be and he is hereby authorized <br />and directed to enter into contract for said improvement in the manner <br />provided by law, which improvement, in accordance with Article <br />Section 16 of the Charter~has been estimated by the Director of Public <br />Works to have a life of 20 years. <br /> <br />Section 3! That for the purpose o~ paying the cost and expense of said <br />improvement there is hereby levied and assessed a special tax upon the <br />several lots and parcels of land designated in and in accordance with <br />Estimated Assessment No. ~ll as made for tha~ purpose by the Director <br />of Financs and recommended to this Council by the Board of Revision <br />~f Assessments. Said estimated assessment was made on the basis of <br />speOial benefits conferred by said improvement on the several parcels <br />of land therein described and the same is hereln confirmed, adopted <br />and approved,' <br /> <br />Section $: That the owners of the several l~ts or parcels of land in-. <br />cluded in said assessment Shall pay the amounts from them severally <br />due as shown by Column No.~3 of said Estir~%ted Assessment No. ~ll to the <br />City Treasurer on or before thirty days fro~ {he date of the passage of <br />this ordinance, at their option, and in default thereof said specmal <br />assessment with interest at the rate of ~per cen%um per annum, upon <br />deferred payments, shall be payable to the County Treasurer in 9 <br />annual installments with the regmlar taxes of 1922 to 1930 botk <br />inclusive,- <br /> <br />Section %: That to provide a fund for the ~.y~,*~{',~E the pertiion of <br />the cost and expense for which the special assesc~.~ent herein is levied <br />for said improvement, The Mayor and Director of Finance be and they ar <br />hereby authorized to iasue 9 bonds of the City of Lakewooa. Ohic in <br />the aggregate sum of $39,978.00 of which bonds one bond in the sun~ of <br />$$,$$2.00 shall be due and payable on October l, 1923 and one bond in <br />the sum of $,$,$$2.00 <br /> <br /> <br />
