BE IT ORDAINED by the Council of the City of Lakewood, State of Ohio, three, fourths of all members thereef concurr~ng~ Section l~ That it is hereby determined to proceed with the improve- ment Of Nelson Avenue from Cannon Avenue t6 the Nickel Plate Railway by pav~ng sa~e with brick or bituminous concrete, or sheet asphalt or asphalt block, or bitulithic, or cement concrete, doing any and all grading, draining and curbing ~nd constructing curb connections inci- dental and necessary thereto. in accordance with Resolution Nc. 1971 pas~ed ~arch 6,~&922 and in accordance with pIans~ specifications, estimates and profiles here- tofore approved and now on file in bhe office of the Director ef Public ~ork~ Section 2: That all claims for d~mages resulting from said improve- merit shall be j d~c~ally inquired mnto after the co~mpletion thereof~ and that the Director of Publzc Works be and he is hereby authorized and directed to enter into con~rac~ for ss. id improvement in the manner provided by law, which improvement, mn accordance with Article 15~ Section 16 of the Charter~has been ,estimated by the Director of Public Works to have a life of 2'0 years. Sectio~ ~! That for the purpose o~ paying the cos~ and expense of said improvement there is hereby levied and assessed a special tax upon the several lots and parcels of l~nd designated in and in accordance with Estimated Assessmen~ No. ~03 as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision e~ Assessments. Said estims, ted assessment was made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the s~e is heremn confirmed adopted and approved. . Section $~ That the owners of the several l~ts or parcels of land in-. cluded in said assessment ~hall pay the amounts from them severally due as shown by Colt~mn No. 3 of said Estim~ted Assessmen~ No. ~0~ to the City Treasurer on or before ~hi~rty days fro~ ~he date of the passage of this ordinence~ at their option, and in def~ul~ thereof said special assessment with interest at the ra~e of ~{-per centum per annu~, upon deferred payments, shall be p~yable to the County Treasurer in 9 annual ~ns~allments with the regular ta~es of 1922 to 1930 both inclusive, Section ~ That to provide a fund for the ~'~.?:]*at .)E the per.lion of the Cost and expense for which the special s, sse~:.~nt herein is levie~ for said improvememt.
