ORDINANCE No, 2218 by Mr. tteidloff AN ORDINANCE determining to proceed with, and levying and assessing a special assessment to pay the cos t and expense of improving L~kewood Heights Boulevard from Fayle Avenue to Cerabell Avenue by paving same with brick or bituminous concrete or sheet asphalt, or asplmltic confers or cement concrete, doing any and all g~ading, draining and curbing incidental and necessary thereto. BE IT ORDAINED BY Thee COUNCIL OF TI~E OIT~ OF LAKEWOOD, O0~RPI~f._ OF CUYAHOGA, STA~ OF OHIO, three-fourths of all members e~ncul~rLug'~ Section 1. That it is hereby determined to proceed with the improve- sent of Lakewood Heights Boulevard from Kyle Avenue to Carabell Avenue by paving same with brick or bituminous co, crete or sheet asphalt, or asp~haltic conrete, or cement concrete, doing any and all grading, dralni: aha curbing incidental and necessary thereto, in accordance with Resolut No~ 2174 aSopted April 21, 1~24, and in accordance with plans, specifics tions, estim~.tes and profiles heretofore approved and now on file in the office of the Director of Public Works. Section 2: That all claims for damages resulting from said improvement shal~l be Judicially inquired into after the completion thereof and that the Director of Public Works be and he is hereby authorized and directed to enter'into contract for said improvement in the manner p~ovided by law, which improvement in accordance with Article 18~ Section 18 of the Ohar tar has been estimated by the Director ~f Public Works to 2mve a l~fe of 20 years~ ~ Section 5~ That for the purpose of paying the cost and expense of said improvement there is hereby levied and assessed a special assessmen' upon the several lots and parcels of land designated in and in accordanc with the estimated assessment (No. 581) as made for that purpose by the Director of Finance and recommended to this Council by the Boa~l of Revision of Assessments and aggregating $8,552~00. Said estimated assessment is hereby determined to have been made on the basis of specie benefits conferred by said improvement on the several parcels of land therein described and the same is herein confirmed, adopted and approved Section 4~ That the owners of *_.be several lots or parcels cf land included in said assessment shall pay the amounts f~om them severally due as shown by column #$ of said estimated assessment #581 to the City Treasurer on or before thirty days /~om the date of the passage of the ordinance, at their option, a~Dd in default thereof said special assessme with interest at the rate of ~$~¥er centum per annum upon deferred pay- ments shall be payable to the County Treasurer in 10 annual installments with the regular taxes of l~2A to 1~ both inclusive.
