ORDInAnCE N0. <br /> <br />By Mr, Hart <br /> <br />AN ORDINANOE ame=~n2 Ordinance No. 2223 passed by this Council June 23, 1924, entitled <br />.An Ordinance to convey a certain parcel of property not needed for any municipal purpose <br />by the State of Ohio for the purpose of erecting thereon an armory and barracks.. <br /> <br />BE IT ORDAINED by the Council of the City of Lakewood~ State of Ohio. <br /> <br />Section 1, That Section No. 1 o~ Ordinance No. 2223 be and hereby is amended to read as <br />follows, <br /> <br />That it is deemed advisable to convey the following described property to the State of <br />Ohio for the erection thereof of an armory and barracks and which armory ~nd barracks may <br />also be used for other State p~rposes and that said deed contained a condition as follows: <br /> <br /> ~fhat in the event the within described premises and any'buildings erected there~ <br />~y the State of Ohio for the use of state purposes are abaendoned by the State of Ohio, <br />then~ and in that event~ the title to the land shall revert to the City of Lakewood in <br />fee simple, and the City of Lakewood, its successors and assigns to have the privilege to <br />purchase the Build~s thereon at · price to be agreed upon by three appraisers, one to bt <br />appointed by the City of Lakewood~ its successors and &seig~ olio by the State of Ohio <br />amd these two to appoint a third appraiser. ~n the event the City of Lakewood. its succor' <br />ors and assigns, does not care to purchase the building or buildings erected thereen~ the~ <br />the State of Ohio shall have the privilege to sell the land and buildings on the followi~ <br />eenditions,-The three appraisers appointed in the aforesaid manner shall appraise the hum <br />lng or Buildings And the land separately, and may then be sold to some third party and th~ <br />City of Lakewood~ its successors and assigns~ shall receive as its share of the sale price <br />the amount as stated by the appraisers for the land, and the State of Ohio, shall receive <br />for its share from the sale price for the buildings erected thereon as stated by the <br />appraisers for the appraisal of the buildings, And the City of Lakewood, its successors a~ <br />assigns shall have the further right to place into such deed of conveyance, the necessary <br />restrictions and conditions as it may see fit." <br /> <br />Situated in the Village of Rocky River~ Rockport T~waship~ Section No. 23, County <br />of Cuyahoga, State of Ohio, bounded And described as follows~ <br /> <br />Begirming at a point in the line Between 5ectious Nos. 18 And 23, Rockport Township, <br />68~ feet east of a monument situated at the southeast corner of property heretofore <br />conveyed to the City of Lakewood and described in Volume ?~6, Page 40~, Cuyahoga <br />County Record of Deeds, said point of beginning is further described as being 836.46 <br />feet west from · non. sent at the intersection of the center lines of Madison Avenue <br />and Riverside Roadj thence due east insaid line between Sections Nos. 18 and 23 a <br />distance of 27~ feet to a point in the center o~ Rocky Riverj thence north ~o 13' 00, <br />east a distance of 30~.6~ feet to a point! thence' north 29° 09'00" west a distance of <br />398.2~ feet to & point; thence north 60° 09' O0~ west · distance of ~37 feet to a po~ <br />thense north 78° OO, 00" west · distance of 7~.30 feet to a pointj thence north <br />78° 00' 00~ west a distance of ?~30 feet to a point! thence due south a distance of <br />80~o28 feet to the place of beginning and containing 7.219 acres be the same more or <br />less · ~ <br /> <br />Section <br />hereby repealed. <br /> <br />Section ~ This ordinance shall take effect on and after its passage and at the earliest <br />period allo~ed by <br /> <br />Adopted, ~ ~July 28t 1924 <br /> <br />James Gore, sen <br /> <br />president <br /> <br />Approved~ <br /> <br />E.
