ORDINANCE N0~" <br /> <br />AN ORDINANCE determin~ng to proceed w~t~ and levying and assessing a <br />special assessment to Day the cost caud expense of improving ~ <br /> <br />~ IT ORDAINED by the Counc~Z of t~ ~ C~ty of I~akewood Co~.nty of <br />Cuyahoga, State of Ohio. three~fo~'t'.-s of all members concurring: <br /> <br />Section l: That it is hereby determined to prooeed with the improve- <br />ment of ~t~$I~$~ ~ ~$~~ ~ ~m <br /> <br />in accordance with ~Resolutton No. ~ mdopted ~ ~$~~ <br />and ~n accordance with plans, spe0ificat~ons, estimates aha pr¢:xiles <br />heretofore approved and now on f~le in the o~fice of the Director of <br />Public Works. <br /> <br />~ection 2: That all claims for damages resulting from said improve- <br />ment shall be judicially inquired into after the completion thereof <br />and that the Director of Public Works be and he ~s hereby authorized <br />and directed ~ enter trite contract for se~id improvement in the <br />manner provided by law, which improvement in accordance with Article <br />15, section 16 of the Charter has been estimated by the Director of <br />public Works to have a life of~ years. <br /> <br />Section ~: That for the purpose of p~y~ng the cost and expense of <br />said improvement there ~s hereby levied and assessed a special assess- <br />ment upon the several lots and parcels of land ,designated in and tn <br />accordance with the estimated assessment (No. ~ ), as made for that <br />purpose by the Director of Finance and recommended to this Council by <br />~he Board of Revision of Assessments and aggregating not to exceed <br /> ~t.~OeOO Said estimated assessment is hereby determined to have <br />been made on the basis of special benefits conferred by said improve- <br />ment on the several parcels of land there~n described and the same is <br />herein confirmed, adopted and approved~ <br /> <br />Section 4: That the owners of the several lots or parcels of land <br />included in said assessment shall pay the amounts from them~se~verally <br />due as shown by column ~3 of said estimated assessment No. $~ <br />to the City Treasurer on or before thirty days from the date of the <br />passage of the ordinance, at their option, and in default thereof <br />said special assessment with interest at the rate of ~ per centum <br />per annum u~on deferred payments shall be payable to the County <br />Treasurer im~ annual installments, with the regular taxes of.~ <br />to ~ both inclusive. <br /> <br />Section 5: That said annual payments of said assessments ~nd all <br />portions thereof and interest thereon shall be applied to the pay- <br />ment of bonds to be issued in anticipat'ion of the collection thereof <br />~ud the ~nterest thereon as the same shall become due and to no <br />other purpose wha~soevero <br /> <br /> Section 6: This ordinance shall be in full force and effect from and <br /> after the earliest period allowed by law. <br /> <br />Adopted:, <br /> <br />Approved: E.
