ORDINANCE NO, 3221 By Mr. Myers <br /> <br />AN ORDINANCE to repeal Section 24 of O~d~nanoe ~o. 1786, entitled eau Ordinance pre- <br />viding for the zoning and districting of the City of Lakewoed and the regula//on of <br />the location, bulk, heights and uses of buildings and other structures and premises <br />and repealing Ordinance No. 1479" and to enact a new Section 24 of said Ordinance <br />No. 1786 relating to amendments-of said ordinance. <br /> <br />BE IT ORDAINED BY T~E COUNCIL OF ~,h.: CITY OF LAKE~OC/), STATE OF OHIO, ~we-thirds of <br />all members ~hereof concurring: <br /> <br />Section 1. That Section 24 of Ordinance No. 1786, entitled "Au Ordinance providing <br />for the zoning and districting of the City ef Lakewood and the regulation ef the <br />location, bulk, heights and uses of buildings and other structures and pr~m~ scs <br />andrepeating Ordinance No. 1479", which section of said ordinance reads as follows: <br /> <br />"Section 24. AMEKDMEI~TS - The Council may from time to time on <br />its own motion or on petition, after public notice and hearing, <br />amend the regulations and districts herein established in a <br />manner provided by law. Every suoh proposed amendment shall be <br />referred by ~he Council to ~,he city platting commissioner for <br />r~po~%. Any such amendment that has failed ~o receive the <br />approval of the city platting commissioner shall not be passed <br />by the Council except by a four-fifths vote. If a protest against <br />such amendment be presented duly signed and acknowledged by the <br />owners of 20% of the land within such area proposed to be altered, <br />such amendment shall not be passed except by a four-fifths vote <br />of Council. If such amendment will transfer an area to a less <br />restrictive use, height or area district and a protest is presented <br />duly signed and acknowledged by the c~rners of 20%or,he land <br />adjacent to and within 200 feet from such area proposed to be <br />transferred and within s more restricted use or height district <br />than ~he district to which such area is proposed to be ~rans- <br />ferred, such amendment shall not be passed except by a four-fifths <br />vote of the Council. Whenever the owners of 50% of ~he land in <br />any area shall present a petition duly signed and acknowledged to <br />the Council requesting an amendment of the regulations prescribed <br />for such area, it shall be the duty of the Council to vote upon <br />such amendment within 90 days of the filing of same by the peti- <br />tioners with the City Clerk. If any area is herea/~cer transferred <br />to another district by a change in the district boundaries By <br />amendmen2 as provided in ~3is section the provisions of this ordi- <br />nancewith regard to buildings or premises existing at the time <br />of the passage of ~his ordinance shall apply to buildings or <br />premises existing in such transferred area at the time of the <br />passage of such amendment." <br /> <br />be and the same is hereby repealed. <br /> <br />That in lieu of said repealed section it is hereby provided that a new section 24 <br />shall be adopte~ reading as follows~ <br /> <br />"Section 24. The Council may from time to time on its o~ motion <br />or on petition amend said ordinance No. 1786 in the manner provided <br />in the Charter of the City of Lakewood." <br /> <br />Section 2.
