ORDINANCE NCo 3392 By Mr. Hurd <br /> <br /> An ordinance regulating the use of noise making instruments on or near <br />public streets and places and repealing Ordinance No. 3153 and all ordinances or <br />parts of ordinances inconsistent herewith. <br /> <br />BE IT ORDAINED by the Council of the City of Lakewood~ State of Ohio: <br /> <br /> Section 1. It shall be unlawful for any person before the hour of <br />9 o~clock AoNo and after the hour of 6 o~clock P.M. and on Sundays~ Lincoln, s <br />Birthday, Washington~s Birthday, Decoration Day, Fourth of July, Labor Day, <br />ThanksgivAng Day~ Christmas Day and New Year~ s Day~ to blow or cause to be <br />blown ar~ whistle, horn or other noise making instrument calling attention to <br />goods, wares or merchandise offered for sale from drays, carts or baskets upon <br />the streets of the City of Lakewood, or on the outside of any house or building <br />therein, and no person shall, between said hours and on said listed days, use <br />any noise making instrument for the purpose of announcing or calling out in a <br />voice greater than ordinary conversational tones, the sale of any newspapers or <br />merchandise of any kind, and between said hours and on said listed days, no person <br />shall by ringing any bell, blowing ar~ whistle~ shooting, playing any hand ~rgan, <br />street piano o.r otherwise making any loud noise on the streets of the City of <br />Lakewood, within five hundred (500) feet of any school building, hoSpital, asylum <br />or other public institution, and no person operating any place for the sale of <br />merchandise, moving picture show~ picture theatre, or other show, exhibition~ <br />performance or place of amusement, shall cause or permit to be operated thereat <br />any graphaphone, talking machine~ music box, radio~ or other instrument so <br />placed that the horn thereof will emit the noise, music or sound thereof i~to <br />any public street, place er highway in the City of Lakewood. The district within <br />five hundred (500) feet of a hospital shall be officially known as "Hospital <br />Zone or Quiet" and the Director of Public Safety shall designate the zone by <br />suitable signs placed at the outer limits of the zone near the curb lines ef <br />the streets that pass through the zone and adjacent to the hospitale <br /> <br /> Section 2o Any person violating any provisions of this ordinance <br />shall be guilty of a misdemeanor and on conviction thereof~ shall be fined <br />in any sum not to exceed Fifty ($50e00) Dollars, cr imprisoned in the w~rkhouse <br />not exceeding thirty (30) days, or beth~ in the discretion of the Court. <br /> <br /> Section 3. This ordinance shall be in full force and effect at the <br />earliest period allowad by law and thereupon ordinance Ncc 3153 and all other <br />ordinances and parts thereof inconsistent herewith be and they are hereby <br />repealed° <br /> <br />Adopted: ....
