Dawson <br /> <br /> AN E~ERGENCY OBDINANOE authorizing the submission to a vote of <br />the qualified electors of the City of Lakewood of an amendment to the <br />Charter of the City of Lakewood providing for a limitation upon taxes <br />levied without a vote of the people and providing for the levying of <br />taxes outside said limitation upon approval by the majority of the elector <br />at a November election, and repealing Ordinance No. 38~5, adopted by the <br />Council of the City of Lakewood on July 31, 1939. <br /> <br /> WHE. HEAS, an emergency exists for the imm~ediate preservation of <br />the public peace, property, health and safety and to provide fo~ the usual <br />daily operation of the several municipal departments in that in order to <br />secure sufficient funds required for city purposes it is deemed necessary <br />submit a proposed charter amendment to the electors at the next reh~Alar <br />municipal election in the manne~ithin the time provided by the Oonstitu- <br />tion of the State of Ohio, now therefore ~'" <br /> <br /> BE I~ ~DAINED BY THE COUNOIL OF THE- CITY OF .LAEE~00D, OHIO$ <br /> <br />Section 1. That there be submitted to the electors of the City <br />of Lakewood at the regular municipal election to be held Tuesday, <br />November 7, 19~, the follewing proposed amendment to Section <br />29 of Article XV of the Charte~ of the City of Lakewood! <br /> <br />That Section 2~ Of Article XV of the Charter of the Oity of Lakewood <br />now reading ~ <br /> <br /> "Sectlon;29. ~ The ~ouncil shall levy taxes within the limit- <br /> ations provided by law for the purpose of paying the expense <br /> of constructing improvements and exercising the powers of the <br /> city." <br /> <br />be and it is hereby amended to read, as follows~ <br /> <br /> Section ~9-1: Limitation on Rate of ~ax§tion. TT~e Oouncil <br /> ~o~11r _a~nually levy a tax for current operating expenses on <br /> ~ ~ 0 ras~, aepar~F~ents and institlx- <br /> tlons. The rate of such tax shall not exceed five and five- <br /> tenths (5,5) mills on the dollar of assessed valuations. <br /> <br />Section 29-2~ Levy Outside Limitation~ The Co,moil shall <br />a~uually levy outside of the limitation provided in Section 29- <br />· of this Charter a sufficient sum to pay the tzterest, sim~ <br />fund and retirement charges on all bonds andnotes of the City <br />of Lakewood, lawD,~y issued, and the expenses incident to the <br />management of the sinking fund, which entire levy shall be <br />placed before and in preference to all other levies. At, cunts <br />certified under the laws of the state as neoessax~ for such <br />purposes shall not be subject to change by the Couneil. <br /> <br />Section 2~-~ Additional Levies Outside L~!tation, The <br />Council shall also have the power to annually levy outside of <br />the limitation provided in Section 29-1 of tLls Oh~ ter, the <br />amount determdned by Council to be necessary for the firemen% <br />pension fund and the police pensions fund witl~n the limitation <br />prescribed by the laws of the State of Ohio, a sufficient amoun <br />to cover deductions by the cozu~ty auditor from tax receipts for <br />election expense, the annual premiums for worlmaen~s cor~pensatio <br />to the Industrial Co~dssion of Ohio, expenses and services <br />rendered by the State of Ohio and other expenses of the general <br />fund prepaid by the county, an amo~ut sufficient ~$~,the <br />city% participation under the Municipal E~ploye&~C~;-t~ne <br />amount determined by Council ~b be neeessa~y for poor relief <br />and for operatio~ of Lakewood Hospital which amount shall in no <br />event exceed five-tenths {0.5) of a mill, and all charges or <br />assessments made against the City by or pursuant to the Conserv <br />Act of 0hlo. <br /> <br /> <br />
