ORDINM~CE NO. 3893 BY lvir. Fahrenbach AN~P~GENCY ORDINANCE authorizing the settlement of the claim of Clyde E. Bender for dameges to his automobile caused by defect in pave- ment. · HEREAS, on or about December 24, 1939, at about 10:00 o'clock P.~. v~nile Clyde E. Bender was driving his automobile along the street in front of 1293 2~arlowe Avenue, the drain plug was torn from the bottom of the crank case of his automobile on account of ~efective pavement, settle- ment of v~ich claimby the payment of the sum of Six Dollars and Forty- four Cents ($6.44) m~s approved by Council at its meeting on March 4, 1940; and V.~KREAS, an emergency exists to provide for the usual daily op- eration of a mnnicipal department arising out of the necessity of settling said claim promptly, now, therefore, BE IT ORDAI~D BT THE COUNCIL OF Tm CITY OF LAKE~.~OOD, STATE OF 0HIO: SECTION 1: That the Director of Finance be, and he is hereby, authorized to pay to Clyde E. Bender of 11125 Lake Avenue, Cleve- land, Ohio, the sum of Six Dollars and Forty-four Cents ($6.~4) from theGeneral Fund - Damages Paid by the City, in full settle- ment of his claim against the City of La~ewood for damages to his automobile caused by the breaking of the drain plug on the bottom of the crank case of his automobile on account of defec- tive pavement on or about December 24, 1939, upon receipt of satisfactory release signed by said Clyde E. Bender releasing the City of Lakewood from any and all further claims in connection therewith. ~ECTION ~ That this ordinance is hereby declared to be an em- ergency measure for the reasons stated in the preamble hereof and, provided it receives the affirmative vote of two-thirds of ~ll members elected to Council, it shall take effect and be in force immediately upon its adoption ~nd approval by the ~.~yor.
