Fahrenbach <br /> ARr ORDINANCE authorizing the submission to a vote of the electors of the City <br /> of Lakewood of an amendment to the Charter of the City of Lakewood providing for a <br /> limitation upon taxes levied without a vote of the people. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEV~OOD, ESTATE OF OHIO: <br /> Section 1. That there be submitted to the electors .of the City of Lakewood <br /> at a special election to be held Tuesday, November 7th 1944, the following proposed <br /> amendment to the charter of the City of Lakewood: <br /> That Section 29 of Article $4 of the Charter of the City of Lakewood now read- <br /> ing: <br /> "Section 29, Taxes may be levied without a vote of the. people for the <br /> current operating expenses of the city during 1943 and 1944, upon the tax <br /> duplicates for 1942 and 1943, but no such tax shall be levied at a rate <br /> <br /> ` exceeding by more than two and nine-tenths (2.9) mills, the rate for such <br /> purposes within the constitutional limitation allocated to the city an the <br /> 193$ tax duplicate. <br /> Except as above stated, all power to tax shall be as defined and 7;mited by <br /> the Constitution and Statutes of the State of Ohio. <br /> This section shall take effect and be in force immediately upon its adoption <br /> and present Section 29 of Article XV of the Charter of the City of Lakewood <br /> shall be repealed." <br /> be and it is hereby amended to read, as follows: <br /> "Section 29. Taxes may be levied without a vote of the people for the current <br /> operating expenses of the city during 1945, 1946, 1947 and 1948, upon the tax <br /> duplicates for 1944, 1945, 1946 and 1947, but no such tax shall be levied at <br /> a rate exceeding by more than two and nine-tenths (2.9) mills, the rate for <br /> such purposes within the constitutional limitation allocated to the city on <br /> the 1938 tax duplicate. <br /> Except as above stated, all power to tax shall be as defined and limited by <br /> the Constitution and Statutes of the State o£ Ohio. <br /> This section shall take effect and be in force immediately upon its adoption <br /> and present Section 29 of Article 8V of the Charter of the City of Lakewood <br /> shall be repealed.^ <br /> Section 2. That said proposed amendment shall be submitted by ballot to the <br /> electors of the City of Lakewood at a special election to be held Tuesday, November 7th, <br /> 1944, and if such proposed amendment s„approved by a majority of the electors noting <br /> thereon, it shall become a part of the Charter of the City of Lakewood, effective as <br /> of the date of the adoption thereof and,the present Section 29 of Article XV of the <br /> Charter of the City of Lakewood shall thereby be repealed. <br /> Section 3. That the Clerk of the Council is hereby authorized and directed <br /> to certify a copy of this ordinance to the Board of Elections of Cuyahoga County, Ohio, <br /> immediately upon the passage of this ordinance,. and to mail, not less than thirty (30) <br /> days prior to the date of such election, a copy of the proposed amendment to each <br /> elector whose name appears upon the poll or registration books of the last regular or <br /> general election held in theCity oY Lakewood. <br /> Section 4. This ordinance shall take effect and be in force from and after <br /> its passage at the earliest period allowed by law. <br /> Adopted; July 24, 1944 George F.
