ORDINANCE No. 4504 by Mr. Fahrenbach <br /> <br /> AN EMEHGENCY ORDInaNCE authorizing the settlement ef the claim <br /> of Catherine Lowry for personal injuries sustained and expenses incurred <br />by reason of falling on an alleged defective sidewalk. <br /> <br /> W~.RE~S, Catheri%e Lowry incurred personal injuries on or about <br />April 1, 1947' at about 9:50 P.E. o'clock in front of or near 15206 Madison <br />Avenue by reason of falling on an alleged defective sidewalk, and <br /> <br /> V~EREAS~ this ordinance constitutes an emergency in that in order <br />to save the City from litigation, unnecessary expense, and possible <br />additional' obligations~ it authorizes the immediate settlement and adjustment <br />of said claim and provides for the usual daily operation 'of a municipal depart- <br />ment, now~ therefore~ <br /> <br />0HIO: <br /> <br />BE IT ORDAIED BY THE OOUNCIL OF THE CITY OF LAK~VOOD, STATE OF <br /> <br /> Section lo That settlement of the claim of Catherine Lowry for <br />the sum or-One Hundred Dollars ($100.00) is hereby authorized, conditioned <br />upon the execution and delivery by Catherine Lovrry and her husband~ Patrick <br />J. Lowry~ of a full release in favor of the City of Lakewood duly approved <br />by the Director of Law. <br /> <br /> Section 2. hat the .D~rector of Finance be, and he' is hereby, authorized <br />and directed to pay the sum of One Hundred Dollars ($100.00) to Catherine Lowry <br />upon delivery to him of the foregoing release duly executed and approved~ and <br />to charge the ssme to the General F~nd - Damages Paid by the City. <br /> <br /> Section ~.
