ORDINANCE No. 4563 by Mr. Q~nn <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Nayor, on behalf of the City of <br />Lakewood, to purchase the certain real estate located on Belle AVenue in the City <br />of LakewoOd hereinafter more particularly described. <br /> <br /> WHEREAS, this ordinance constitutes an emergency in that, by legislation <br />heretofore adopted, this Council has appropriated and instructed the Director of <br />Law to proceed with action to assess compensation with respect to the property <br />hereinafter described which action has been ffl~d in the Court of Common Pleas of <br />of Cuyahoga County; in that settlement of this action has been reached whare~y <br />the owners haVe agreed, to sell said property for the consideration hereinafter <br />stipulated which this Council deems to ~be in the best interests of the City; and <br />in that it provides for the public health and welfaz~ and the usual daily operation <br />of a municipal department, n~ thercfore~ <br /> <br /> BE IT ORDAINED BT THE OOUNCIL OF THE CITY OF LAKEWO~)~ STA~E OF OHIO: <br /> <br /> E Section 1. That the Mayor be~ and he is hereby, authorized to purchase <br /> ~rom sther E. Freudemann and Irene E. Bender the following described property: <br /> <br /> Situated in the City of Lakewood~ County of Ouyahoga, <br /> and State of Ohio~ and known as being Sublot No.126 <br /> in the Belle Avenue Allotment, of a part of Section <br /> Uo. 22, Original Rockport T~nship~ as shown by the <br /> plat recorded in Volume 41~ Page 23, Ouyahoga Oour~y <br /> ~ap Records, and being a parcel of land on the east <br /> side of Belle Avenue, 45 feet wide and extending east <br /> on the north line 188.24 feet and 188.14 feet on the <br /> south line, and 45 feet in the rear, be the same more <br /> or less, but subject to all legal highways. <br /> <br />and to pay tberefor the sum of Seventeen Thousand and Five Hundred Doll~s ($17~500.¢ <br /> <br /> Section 2. That the title to said property shall be subject to t~e approw <br />of the Director of Law; that rentals, taxes and assessments shall be pro-rated as <br />of the dat~e of transfer; that the Director of Plnance be, and he is hereby~ <br />authorized to pay the amount set forth in Section 1 hereof from the Hospital Buf/d!~ <br />Improvement ~nd upon delivery by Esther E. Freudemann and Irene E. Bender of their <br />Warranty Deed, bearing signature of George H. Bender, to the City of Lakewoo~, roger! <br />with Guaranty of Title disclosing the said real estate to be free and clear of <br />all encumbrances, excepting ta~es and assessments not yet due and payable, Sorting <br />ordinances and restrictions of record, if any; and that the Director of F~nce be, <br />he is hereby, authorized to pay the costs i~idental to the completion of the puroha~ <br />of said real estate, including the cos~ of recording the Deed and one-half of the <br />escrow agent's fee from said fu~d.. <br /> <br /> Section ~..
