O'Donnell. <br /> <br /> ~!AS, in the purchase of other properties for 4~ospitaI <br />purposes, the money available for real estate for said purpose has been <br />exhausted and, in the opinion of this Council~ no furtDmr per%ion of the <br />proceeds of the bond issue for h~spital purp~ses sh~ld be used at this <br />time for the purpose of ac~miring real estate; ' and ~ <br /> <br /> ~S, this ordinance constitutns an ~mergency in that an appropria- <br />tion action is n~v pending and, by reason of the non-availability of money <br />for the purpose, it is desired to dismiss said action and in or. der to provide <br />for the public welfare and the usual daily operation of a municipal department, <br />now~ therefore <br /> <br />BE IT OP~DAIA~D BY THE COUNCIL OF TF~ CITY OF LAKEWOOD, STATE OF ~I0~ <br /> <br /> Section 1.~ That Ordinance ~o. 4550 adopted May 3, 1948 directing the <br />aPPropriation of property and all other ora~"nces and resolutions inconsistent <br />herewith, including resolution 11o. ~353 adopted April 5, 1948 be, and they are <br />hereby~ repealed. . <br /> <br /> Section 2. That the Director of Law is authorized and ~ected to <br />cause the entry of "Dismissed without ~eJudice at plaintiff's costs" to be <br />mede in the action now pending in the Oou~ of o°m~on Pleas of Cuyahoffa County <br />as Case No. 560679 and entitled ' City of Lakewood, Plaintiff vs. Frank X: <br />O~Donne!l~ et al.~ Defendant~. . <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and, provided it recei~s <br />the affirmative vote of t~vo-thirds of all members elected to Council, it shall <br />take effect and bc in force ~mmediately upon its adoption ,n~ approval by the <br />Mayor, and Ordinance No. 4550 and all other ordinances and resolutions <br />inconsistent herewith~ including Resolution No. 3353 shell be, and they are <br />hereby, repealed. <br /> <br />Adopted: <br /> <br />1945 <br /> <br />Approved: JUly 6~ 1948 <br /> <br />?m?
