<br /> AN E~ERGENCY ORDINANCE authorizing the Nayor on Beb~l ~ of the City of
<br />Lek,wood to grant a temporary easement on and across the property hereinafter more
<br />specifically described to Peter Koenig for ingress and egress, parking and other
<br />purposes, all subject to the terms and conditions as hereinafter provided,
<br />
<br /> WHEREAS, this ordinance constitutes an emergency in that Peter Koenig is
<br />nearing, completion of the construction of a buildt ~ and improvement of his premises
<br />on Hil~ard Road near Weetwood Avenue and ~w~ediatel~ adjacent to the property herein-
<br />after described, and in that this ordinance provides for the ~w~ediate public safety
<br />and the usual ,~-t'l~ operation of a municipal department, r~w, therefore,
<br />
<br /> BE IT ORDAINED B~ THE COUNCIL OF THE Cl"ff OF LAEEW0OD, STATE OF OHIO:
<br />
<br /> Section 1. That the Ma~or be, and he is hereby~ authorized and. directed
<br />on behalf of the City of Lakewood te enter into an !-_-trument of easement with Peter
<br />Xoenig, which easement shall be in words ~_-d figures substantially aa follows~
<br />
<br /> "KNOW ALL MEN BI THESE PRESENTS that the City of Lek,wood, a munici-
<br /> pal corporation, the Grantor, for and in consideration of the sum of
<br /> One Dollars ($1.00) payable to the City ann~ in advance !F Peter
<br /> Xoenig; does hereby grant unto Peter Xoenig, the Grantee, his he,rs,
<br /> successors and assigns subject to the terms, conditions, covenants
<br /> and agreements hereinafter set forth, a temporary easement for the-
<br /> purposes of ingress and egress to and from his property and for park-
<br /> ing, in, over, .through, upon and across the prom,-es of the Grantor
<br /> described as
<br />
<br />Situated in the State of Ohio, County of Cu~ahoga, Section
<br />No. 22, Original Rockport Township, Bounded and described
<br />as follows:
<br />
<br />Beginning at the intersection of the south line of Hil~rd
<br />Road (60 feet wide) and the east line of Nestwood Avenue
<br />(~O feet wide); thence in the southerly line of Hil~4rd
<br />Road north ~O° 32~ 30" east, 119~82 re,ti thence North
<br />39° 27' 30" west, 1~,~0 feet to the Back curb, line of
<br />Hil]~rd Road; thence south 50° 32: 30" west 103,41 feet~
<br />thence south ~o 18' 30" west, 23~39 feet to the place of
<br />beginning.

<br />The ~rantee, IF the acceptance of delivery of this grant of easement,
<br />agrees to the following terms, conditions, co~enants and agreements in
<br />respect to the exercise of his rights hereunder~ to-wit~
<br />
<br /> 1. The Grantee shell pave, with concrete, the entire
<br /> parcel hereinbefore described.
<br />
<br />The Grantee shall i~tall a bumpe.r guard on the above
<br />described premises and along Hill~rd Road at such height
<br />and at such distance from the paved portion of Hil]~r~
<br />Road as shall be satisfactory to the Grantor, to the end
<br />that automobiles will not exte~ over the curb or come
<br />over the curb into Hilliard Road.
<br />
<br />The Grantee shall not disturb the present Hillia~d Road
<br />curb IF cutting or other.,lee, permit'any driveway from
<br />his property directly into Hilliard Road, nor permit
<br />vehicles to drive into or out of his proper~t~y directly
<br />into ~illiard Road.
