ORDINANCE NO. 4632 <br /> <br />BY Mr. Quinn <br /> <br /> AN EMERGENCY ORDINANCE authorizing the M~or, as Director of Public Works, <br />to accept the Warranty Deed from Robert K. Beck, conveying to the City of Lakewood <br />the title to the property hereinafter described for street and other public purp~ es. <br /> <br /> ~tEREAS, an emergency exists in that private property adjacent to the pro- <br />perty hereinafter described has been developed requiring ~mmediate improvement in <br />Detroit Avenue by widening and otherwise, and in order to provide, for the public <br />welfare, safety and the usual daily operation of a municipal department, now, there- <br />fore, <br /> <br /> BE IT ORDAINED BT THE 00UNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. Tha% for use for street and ether public purposes the M~yor, <br />as Director of Public Works, be, and he is hereby, authorized, conditioned on the <br />issuance to the City of Lakewood of a Guarantee of T.itle disclosing maid property <br />to be free and clear of all encumbrances excepting taxes and assessments for the <br />year 1949 and thereafter and zoning ordinances if ar~, to accept on behalf of the <br />City of ~akewood, a Warranty Deed from Robert K. Beck conveying to the City the <br />following described property, to-wi%t <br /> <br />Situated in the City of Lakewood, County of Ouyahoga, <br />State of Ohio, being part of Original Rockport Township, <br />Section No. 22, and being parts of Sublots Nos. 64 and 65 <br />in the Mars E. Wagar Subdivision, as recorded in Volume <br />28, Page 27 of Cuyahoga County Map Records, and is further <br />described as fo!lows: <br /> <br />Beginning at the intersection of the easterly line of Mare <br />Avenue (66 feet wide) and the southerly line of Detroit <br />Avenue (66 feet wide) as shown by said plat; thence from <br />said place of beginning southerly along the easterly line <br />of Mare Avenue, 22.50 feet; thence easterly parallel to the <br />southerly line of Detroit Avenue about 147.25 feet to the <br />easterly line of Sublot No. 65 aforesaid; thence northerl~ <br />in the easterly line of said Sublot No. 65 a distance of <br />22.50 feet to the southerly line of Detroit Avenue; thence <br />westerly in the southerly line of Detroit Avenue to the <br />place of beginning. <br /> <br /> Section 2. The Director of Finance is hereby authorized to pa~ to Robert <br />K. Beck the amount of One Dollar ($1.00) indicated in said Warranty Deed as con- <br />sideration for the conveyance, to pay the cost of recording the deed and one-half of <br />escrow charges and charge the same to the "Gasoline Tax Fund". <br /> <br /> Section 2. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and, provided it receives the af- <br />firmative vote of two-thirds of all members elected to Council, it shall take <br />effect and be in force ~mmediately upon its adoption and approval by the Mayor. <br /> <br />Adopted: OctOber 17~ 1949 <br /> <br />Approved:..
