<br /> AN E~ERGENC~ ORDINANCE authorizing the Mayor to enter into an agreement with
<br />C~vde K. Lamb for special Services in the conStruction cf a new fire brick lining wall
<br />in the chimney at the Lakewood Incinerator, 1292G Berea Road.
<br />
<br /> WHERF~AS, the lining in the incinerator chimney is in such a bad condition
<br />that it requires replacement by !,,mediate construction of a new wall, in order that the
<br />plant may be operated safely and with as little delay as possible, and,
<br />
<br /> ~11EREAS, the city has purchased the necessary material for this work, and,
<br />
<br /> WHEREAS, the construction of this wall requires special skill of a special-
<br />ized nature, and,
<br />
<br /> ~HEREAS, Clyde E. Lamb has for a long period ~f tim~ euccessf-~ly ~rformed
<br />this special type of work,
<br />
<br /> V/HEEEAS, to advertise for competitive bids would delay the construction of
<br />this improvement from three to four weeks, and,
<br />
<br /> WHEREAS~ an acute emergency exists in that on account of said condition the
<br />incinerator must be shut down forthwith and in that the non-c, ollection of combustible
<br />refuse and garbage would create a serious health menace, and,
<br /> WHEREAS, C]~vde X. Lamb has submitted an offer to cb this work for $8,225,00,
<br />and
<br /> WHEREAS, an emergency exists to provide for the !,,,ediate preservation of
<br />the public property, health and safety and to provide for the usual daily operation of
<br />a mUnicipal department, to wit: Refuse Collection and Disposal Department, now, therefore,
<br />
<br /> BE IT ORDAINED B~ THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF ONIO:
<br />
<br /> Section le That the Mayor be and he is hereby authorized to enter into an
<br />agreement with Clyde K. Lamb for special services in the comtruction of a new fire
<br />brick lining wall in the chimney at the Lakewood Incinerator, for the sum of $$,225.00,
<br />without competitive Bidding.
<br />
<br /> Section 2. That in accordance with Mr, Lamb, s proposal he shall furnish all
<br />labor& tools, and equipment, demolish the existing lining and construct a new No. 1
<br />fire Brick lining wall with target wall as follows: First 50 feet 9" Koss, 25 feet 6"
<br />Cupola Block, 25 'feet 4} CirCle Brick, 25 feet of target wall with fire Brick and high
<br />temperature fire Brick cement. Mr. Lamb to demolish the existing lining and the city
<br />to haul away the discarded material. Mr. Lamb shall be required to save the city
<br />harmless from any claims for injury to person or damage to property from an~ cause
<br />whatsoever by furnishing a liability policy and property damage insurance of at least
<br />$50,000.00 and Ohio State ~orkmen's Compensation. Mr. Lamb shall also pay the pre-
<br />vailing wage rates as prescribed by the Department of Industrial Relations of OhiO.
<br />
<br /> Section 3. That this ordinance is hereby declared to be an emergency measure
<br />for the reasons stated in the preamble hereof and provided it receives the affirmative
<br />Vote of two-thirds of all members elected to Council, it shall take effect and he in
<br />force immediately upon its adoption and approval by the Ma~or.
