ORDIN~ANCE NO. <br /> <br />4658 <br /> <br />BY Mr. Gottermeyer <br /> <br /> AN E~{E~GENEY ORDINA/~CE authorizing Settlement of the claim of Mrs. ~amellia <br /> Nowicki for personal injuries and expenses sustained on or about December 17, 1949 <br /> at the intersection of NewmanAvenue and Franklin Boulevard in the ~ity of Lakewood <br /> when Struck by a City truck operated by a ~ity employe. <br /> <br /> ~?~EAS, Mrs. Camellia Nowicki of 1557 Newman Avenue was injured on or <br /> about December 17, 1949 when struck by a truck driven by a City employe as a result <br /> of which she incurred injuries and eXpenses; and <br /> <br /> ~%IEREAS, immediately following her fall, Mrs. Nowickiwas taken to the <br /> LakeWood Hospital where she was cared for from December 17th to December 24, 1949 <br /> and incurred eXpenses for hospital services in the amount of $119.00; and <br /> <br /> %~HEREAS, this ordinance constitutes an emergency in that,Lu order to save <br /> the ~Dityfrenlitigation and possible additional expense, it authorizes the imme- <br /> diate settlement and adjustment of such claims and ProVides for the usual daily <br /> operation of a municipal department, now therefore, <br /> BE IT ORDAINED BT THE COUNCIL OF THE CITY OF LA~WOOD~ STATE OF OHIO: <br /> Section 1. That settlement cf the claim of Mrs. ~amellia Nowicki for the <br /> sum of $500,00 is hereby authorized provided that~of such sum~$119eO0 shall he paid <br /> to the Lakewood Hosoital to cover the hospital charges and the remaining $381.O0 shall <br /> be paid to Mrs. ~am~llia Nowicki couditioned Upon execution and delivery by her of a <br /> full release in favor of the Dity of Lakewood duly ~oproved by the Director of Law. <br /> <br /> Section 2. That the Director of Finance be, and he is hereby, authorized <br />to pay the sum of $I19.00 to Ube LakeWood Hospital and the sum of $381.00 to 5~s. <br />~Camellia Nowicki upon delivery to him of the foregoing release duly executed and <br />approved and to charge the same to the General Fund-Damages Paid by the ~ity. <br /> <br /> Section 3. This ordinance is hereby declared to be an ~mergency measure <br />for the reasons stated in the preamble hereof and,provided it reCeives the affirma- <br />tive vote of twc-thirds of all members elected to~ouncil, it shall take effect and <br />be in force immediately upon its adoption and Spproval by the ~ayor. <br /> <br />resident <br /> <br /> <br />
