ORDINANCE N0. 4686 B~ Mr. Vickery <br /> <br /> AN ~f~.RGENCY ORDINANCE prohibiting the placing cf sand and other s~m~lar <br /> materials on street car rails located within the City of Lakewood declaring a <br /> nuisance and providing a penalty for the violation. <br /> <br /> WHER~.2, an emergency exists in that the placing of sand and like mater- <br /> Aa1, on street car rails in the City of ~aMewood creates a condition dangerous <br /> to the public health and safet~ requiring immediate elimination thereof, and <br /> in that this ordinance provides for the public health, welfare, safety and the <br /> usual daily operation of a ~mtcipal department, now, therefore, <br /> <br /> BE IT ORDAYNED BT TNE COUNCIL ~F THE CITY OF IAKEWOOD, STATE OF OHIO~ <br /> <br /> Section 1. The placing of~ sand or other stmtlar material on street <br />car rails located in the ~ity of Lahew~od, by the pouring or the extrusion <br />thereof from street cars or otherwise for the purpose of testing the street <br />car apparatus or the material used or for ar~ reason other than (1) for the <br />purpose of aiding in making emergency stops or (2) in case of slippery rails <br />due to w~ather conditions, when necessary to start or stop such street cars, <br />is hereby declared to be a nuisance and prohibited. Ar~ person violating the <br />foregoing previsions shall, upon conviction thereof, be fined in an~ amount <br />not in excess of $50.00 for each offense. <br /> <br /> Section 2. This ordtnAuce is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and, provided it receives <br />the affirmative vote of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediate]~v upon its adoption and approval by the <br />Mayor. <br /> <br />Adopted:~ <br /> <br />Wm.
