ORDINANCE NO. 2719 BY Mr. Ward <br /> <br /> UN ~RGENCY ORDINANCE authorizing the Mayor, asDirector of Public <br />Works~ to accept the Warranty Deed from Robert K. Beck, conveying to the City of <br />Lakewood the title to the property hereinafter described for Street and other <br />public purposes. <br /> <br /> WHEREAS, an emergency exists in that the owner of the private property <br />adjacent to the property hereinafter described proposes development thereof; in <br />that the City proposes to widen Detroit Avenue in this area in conformity with <br />other nearby portions thereof; and in that this ordinance provides for the public <br />welfare, safety and the usual daily operation of a municipal department, now, <br />therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That for use for street and other public purposes the Mayor, <br />as Director of Public Works, be, and he is hereby, authorized, conditioned on <br />the issuance to the City of Lakewood of a Guarantee of Title disclosing said <br />property to be free and clear of all encumbrances excepting taxes and assess- <br />ments for the year 1950 and thereafter and zoning ordinances if any, to accept <br />on behalf of the City of Lakewood, a Warranty Deed from Robert K. Beck, and <br />bearing the sigrmture of Dorothy So Beck, conveying to the City the following <br />described property, to-wit: <br /> <br /> Situated in the City of Lakewood, County of Cu~ahoga and <br />State of Ohio, being part of Original Rockport Township, <br />Section No. 22 and being parts of Sublots Nos. i and 2 of the <br />Mars Wagar Subdivision, as recorded in Volume 28, Page 27 of <br />Cuyahoga County Nap Records, and further described as follows: <br /> <br /> Beginning at the intersection of the southerly line of <br />Detroit Avenue (66 feet wide) with the westerly line of Mars <br />Avenue (66 feet wide); thence from said place of beginning <br />southerly along the westerly line of Mars Avenue, 22.50 feet; <br />thence westerly parallel to, and 22.50 feet southerly from, <br />the southerly line of Detroit Avenue (66 feetwide), 142 feet <br />to the westerly line of said Mars Wagar Subdivision; thence <br />northerly along said westerly line 22.50 feet to the southerly <br />line of Detroit Avenue (66 feet wide); thence easterly along <br />said southerly line 142 feet to the place of beginning. <br /> <br /> Section 2. The Director of Finance is hereby authorized to pay to <br />Robert K. Beck the amount of One Dollar ($1.00)~indicated in said Warranty Deed <br />as consideration for the conveyance, to pay the cost of recording the deed, one- <br />half of the escrow charges and taxes and assessments, if any, due to proration <br />thereof as of the date of transfer and charge the same to the "Street Opening <br />Fund.° <br /> <br /> Section 3. This ordinance is hereby declared to be an emergency measure <br />for the reasons stated in the preamble hereof and, provided it receives the affirm- <br />ative vote of two-thirds of all members elected to Council, it shall take effect <br />and be in force immediately upon its adoption and approval by the ~ayor. <br /> <br />Adopthd:.
