ORDINanCE NO. 4728 BY <br /> <br />Mr. Quinn <br /> <br /> An emergency ordinance authoriziug the Director of Finance to pay Dr. Stanley <br />ii, Goldhamer the sum of T~o Hundred Eleven Dollars and Eighty-eight Cents ($211.88) <br />as a moral claim. <br /> <br /> ~EREAS, <br />about October <br />and driven by <br />Avenue in the <br /> <br />the automobile belOnging to Dr. Stanley N. Goldhamer was damaged on or <br />30, 1950 as a result of a collision with a Eity of L~kewood police car <br />Officer 7~lter F. Eloots, such collision occurring at about 2500 ~hester <br />~ity of Gleveland; and <br /> <br /> V~EAS, it is the opinion of this ~ouncil that officer Eloots was engaged in a <br />governmental function in operating the City o~ned autcmobile at the time ~ the collisi, <br />and resulting damages for which reason it considers that the City incurred no legal <br />obligation to Dr. Goldhamer for his said dammges but, nevertheless~ desiring to reim- <br />burse him for actual expenses by reason thereof; and <br /> <br /> ~EAR, this ordinance constitutes an emergency in that settlement may be made <br />on the basis forthwith and in that this ordinance provides for the usual daily opera- <br />tion of a municipal department, now, therefore, <br /> <br />Adopted: ,,, 5' 1951 <br />Approved:. <br /> <br /> BE IT ORDAINED BY THE ~O~,;CIL OF THE CITY_ OF LAI~WOOD, STATE OF OP~O: <br /> <br /> Section 1. That the Director of Finance be, and he is hereby, authorized and <br />directed to pay to Dr. Stanley~..-Goldhamer the sum of T~-o Hundred Eleven Dollars and <br />Eighty-eight Cents ($211.88) as a morml claim conditioned, however, upon the execution <br />and delivery by Dr. Stanley ~. Goldhamer of a full release in favor of the City of Lake- <br />wood and Walter F. ;~oots, duly approved by the Director of I~w; the Director of Financ~ <br />to charge said pavement to the General Fund - Damages Paid By the City. <br /> <br /> Section 2. This ordinance is hereby declared to he an emergency measure for the <br />reasons stated in the pream~ole hereof and, provided it receives the affir~ative vote of <br />two-thirds of all members elected to Council, it shall take effect and be in force imme- <br />diately upon its adoption and approval by the ~ayor. <br /> <br />~yor <br /> <br /> <br />
