C~DINANCE NO. 4781 <br /> <br />A~ EMERGEECY OR~gNANCE authoriziug the Director of Finance <br />to pay ~eouard J. Emecik and Rosemary Eaecik, husband and wife, the , _~:2' ,~,~. <br />sum of Five Hundred Dollars ($500.00), in full of all the property <br />damages and personal injuries resulting frcm the accident hereinafter /)"%~ , <br />described, as a moral claim. /" <br /> <br /> ~P~VAS, the mtcmebile belonging to and operated by Lec~ard <br />J. Emecik, in which Rosemary ~mecik was riding as a passenger, in avoiding <br />a police station wagon operated by Officer Michael F. Spisak was, on or <br />abcut October 27, 1950, forced to the onrb on the southerly side of <br />Franklin Boulevard in the vicinity of Bunts Road in the City of Lakewosd <br />causing some injuries and deranges to the automobile; and <br /> <br /> W~E~.~, it is the opinion of this Council the% Officer <br />Spisak was engaged in a governmental function in operating the city-owned <br />automobile at the time of the resulting injuries and damages, for which <br />reason it considers that the City incurred no legal obligaticu to Mr:i. and <br />Mrs. Emecik but, nevertheless, desiring to re4mburse them for actual ex- <br />penses by reason thereof; and <br /> <br /> ~HE~.~a, this ordinance constitutes an emergency ~n that <br />settlement may be made forthwith and in that this ordinance provides for <br />the usual daily operatic~ of a municipal department, now, therefore, <br /> <br />OF 0~IO: <br /> <br />BE IT C~DAYNED BY THE G0~N.~L OF TH~ ~ CF LAZEW00D, STATE <br /> <br /> Section 1. That the Director of Finance be, and he is <br />hereby, authorized and directed to pay to Ieonard J. Enecik and Rosemary <br />Emecik the sum of Five ~R~ndred Dollars ($500.00) as a moral claim, <br />conditioned, however, upon the execution and delivery by Leonard J. ~_~ecik <br />and Rosemary Emecik of a full release in favor cf the City of Lekewocd <br />and Michael F. Spisak, duly approved by the Director of Lew. The Director <br />of Finance to charge such payment to the General F~nd - General Miscellaneous. <br /> <br /> Section 2. This c~dinance is hereby declared to be an <br />emergency measure for the reasous stated in the preamble hereof and, <br />provided it receives the affirmative v~te of two-thirds of all members <br />elected to Council, it shall take effect and be in force ~mmedistely upon <br />its adoption. <br /> <br />OCT I ' 1951 <br /> <br />APPR(~ED: ~ J <br /> <br /> <br />
