<br /> AN E~RC~ENCY ORDI~NCE authorizing the Mayor on behalf of the City of Lakewood
<br />to consent to the assignment by Conrad, Hays, Simpson and Ruth to Hays and Ruth of
<br />the certain Agreement dated March 21, 1947, by and between the City of Lakewood and
<br />Conrad, Hays, S~pson and Ruth for plan preparation and construction of additional
<br />hospital facilities.
<br />
<br /> WHF~EAS, p~rsuant to Ordinance No. 4472 the City of Lakewood on March 21, 1947,
<br />entered into an agreement with Conrad, Hays, Simpson and Ruth as architects for plan
<br />preparation and construction of additional hospital facilities, and
<br />
<br /> V~tEREAS~ plans were prepared, and the additional hospital facilities were con-
<br />structed in accordance therewith excepting that portion relating to the alteration
<br />of the old hospital structure fronting on Detroit Avenue, for which funds were not
<br />available at the time cf letting the construction contract, and
<br />
<br /> WHEREAS, funds for said alteration have not become' available by the issuance
<br />and sale of bonds, but it is now desired by the City to have some changes made in
<br />the plans relating to the alterations in said old hospital structure, and
<br />
<br /> V~EREAS, the City has been informed that the architectural firm of Conrad~
<br />Hays, Simpson and Ruth was dissolved as of the close of business on January 2, 19~2,
<br />and that in connection therewith the said firm of Conrad, Hays, Simpson and Ruth
<br />have, as of February 8, 1952, assigned all of its right, tit~e and interest in and
<br />to said agreement of March 21~ 1947, with the City of Lakewood, to a new architect-
<br />ural partnership consisting of J. Byers Hays and Paul C. Ruth, doing business under
<br />the name of Hays and Ruth, and
<br />
<br /> WHEREAS, Hays and Ruth have presented to the City of Lakewood the said assign-
<br />ment, together with their undertaking to carry out and perform the said agreement
<br />between Conrad, Hays, Simpson and Ruth and the City of Lakewood, dated March 21,
<br />1947, and
<br />
<br /> WHEREAS, this ordim~nce constitutes an emergency~ in that it is deemed neces-
<br />sary by this Council in the interests of the public welfare and safety to proceed
<br />with said alterations as quickly as possible~ and in that this ordinance provides for
<br />the usual daily operation of a municipal department, now~ therefore,
<br />
<br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF IAKEWOOD, STATE OF OHIO:
<br />
<br /> Section 1. That the Mayor be and he is hereby authorized and directed on be-
<br />half of the City of Lakewood to consent to the assignment by Conrad, Hays, Simpson
<br />and Ruth to Hays and Ruth of the agreement between Conrad, Hays, Simpson and Ruth
<br />and the City of Lakewood dated March 21, 1947, and to accept on behalf of the City of
<br />Lakewood the assumption by Hays and Ruth of all of the obligations of Conrad, Hays,
<br />Simpson and Ruth under tho said agreement to the City of Lakewood,
<br />
<br /> Section 2. This ordinance is hereby declared to be an emergency measure for
<br />the reasons stated in the preamble hereof and, provided it receives the affirmative
<br />vote of two-thirds of all members elected to Council, it shall take effect and be in
<br />force immediately upon its adoption and approval by the Mayor; and all ordinances or
<br />parts of ordinances inconsistent herewith, are hereby repealed.
