ORDINANCE NO. ~83~ BY Mr, C~ttermeyer <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of Finance <br />to pay the sum of $2,380j§1 to A. B. Roberts for consulting engineering services~ <br /> <br /> WHEREAS, on March 24, 1950, the Cuyahoga County Mayors, Association <br />authorized the Chairman to appsint a Water Rate Committee to negotiate with the <br />City of Cleveland for satisfactory water rates en the renewal of sontracts expiring <br />during 1950 and 1951; and <br /> <br /> WHEREAS, pursuant to such action, the Chairman appointed as members of <br />this committee M~yor Mullaney of ~eachwood, City Manager Hutcbt~-on of Bedford, <br />City Manager Ximpel of Cleveland Heights, Mayer Gerdon of Cuyahoga Heights, City <br />Manager Caftan of East Cleveland, Mayor S~m.~ of Euclid, Mayor Wing of Garfield <br />Heights, Mayor ~auffman of Lakewood, Mayor Fre[~neyer of Maple Heights, Mayor <br />8tary of P~rma, a,~ Mayor Van Aken of Shaker Heights $ and <br /> <br /> · HE~F~S, in preliminary negotiations with the City of Cleveland, the <br />co,,,tttee decided that competent Consult~ engineering advice and water ~udiee <br />were essential, but it was not possible t~ determine the extent to which such eon- <br />sulting advice and water studies would be required; and <br /> <br /> WHE~FA.~, at the request of the committee, A. B. Roberts, cons~lting <br />engineer, suhnitted a proposition for furnishing such consulting advice and studies <br />to the committee at an osram-ted cost of $24,3~3.§3 for complete water studies and <br />· recommendations, together with a suggested apportionment of the cost of his fee <br />among the various subdivisions served by the City of Cleveland; :and <br /> <br /> WHEREAS, the co-~ttee by and on behalf of the Cuyahoga County Mayors~ <br />Association approved the retention of Mr. Roberts as consulting engineer to the <br />extent which might be found necessary in the course of negotiations and further <br />approved the apportionment of his fee; and <br /> <br /> ~2~EA~, based upon such approval, Mr. Roberts proceeded from time to <br />time to make the necessary studies and assist the committee in its negotiations <br />with the City of Cleveland; and <br /> <br /> ~HE~W.~8, it eventually developed that complete water et,,~es were re- <br />quired and were made by Mr. Roberts in accordance with his orig~! proposition <br />to the committee; and <br /> <br /> WHEREA~, as the result of such studies and negotiations, the City of <br />Cleveland accepted compromise rates for water representing a very substantial <br />reduction from the .rates originally requested, which compromise rates are now in <br />effect; and <br /> <br /> WHEREAS, this Council recognizes that the services of said A. B. Roberts <br />have resulted in substantial savings to this m,,~t~ipality and its water consumers, <br />and also recognizes the moral obligation of this municipality to provide for the <br />payment of its proportionate share according to the ~n*ormal approval above men- <br />tioned, and hereby determines to provide for such payment; and <br /> <br /> w~EAS, in accordance with the foregoing, A. B. Roberts has presented <br />his statement for services disclosing the proportionate share of the City of <br />Lakewood therefor to be $2,380e81; and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency in that it provides for <br />the ~mmediate payment for services rendered, beginning April 15, 1950, to and in <br />the interests and advantage of the City of Lakewood and its water consumers and <br />in that it provides for the public welfare and safety and the usual daily opera- <br />tion of a municipal department; now, therefore, <br /> <br />~ IT ORDAINED BY THE COUNCIL OF THE CITY OF IAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1, That the Director of Finance be and he is hereby authorized <br />and directed to pay A, B. Roberts the s~ of $2,380e§1 for professional consulting <br /> <br /> <br />
