<br /> AN EMERGENCY ORDINANCE authorizing the sale of a certain parcel o£ land
<br /> at the northeast corner of Delaware Avenue and Niagara Drive, to F~r. Co Ac
<br /> Rawlings.
<br />
<br /> WHEREAS, the City of Lakewood owns a Certain parcel of land at the north-
<br /> east COrner of Delaware Avenue and Niagara Drive, which land is no longer needed
<br /> for municipal purposes, and,
<br />
<br /> WHEREAS, at a meeting of ~his COUncil, Nay ~, I9~2~ Resolution No. 352~
<br /> was adopted, authorizing the Mayor to advertise for bids for the sale of said
<br /> land, and, _
<br />
<br /> W~, the Mayor did advertise for bids, said bids being opened at
<br /> 12:00 o'clock noon, Saturday, July 19~ 1952, at which time Mr. C. A. Rawlings
<br /> submitted a bid of $50~00, was the only bidder and said bid was su~mitted to and
<br /> acCepted by the Council at its meeting, July 21, 1952, and,
<br />
<br /> WHEREAS, it is desired by the bidder and deemed advisable by the COuncil
<br />that this sale be consummated as soon as possible and to provide for the immediate
<br />.preservation of the public property,
<br />tion of a municipal dePartment, now, health and safety and the usual daily opera-
<br /> therefore,

<br />~E IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO:
<br />Section 1. That the property described as follows:
<br />
<br />Situated in the State of Ohio, County of Cuyahoga, Section i8,
<br />Original Rockport Township, now in the City of Lakewood, and
<br />being part of Lot No, 4 in the Commonwealth Realty and Building
<br />
<br /> Company. s Indianola park Subdivision, as shown by plat recorded
<br /> on Page 34, Vol~e 34, Cuyahoga County Record of Maps, bounded
<br /> and described as follows:
<br />
<br /> Beginning at a point in the northwest corner ef aforesaid Lot
<br /> No. 4, and the east line of Niagara Drive; thence easterly in the
<br /> northerly line of Lot No. 4, 130.00 feet to its northeast corner;
<br /> thence south in the easterly line of Lot No. 4, 11.93 feet to the
<br /> northerly-line of Delaware Avenue (60 feet wide); thence westerly
<br /> in the northerly line of Delaware Avenue, 120.04 feet to a point
<br /> · of curve; thence northwesterly in the arc of a curve, whose
<br /> radius is 10.13 feet, an arc distance of 15076 feet to the place
<br /> of beginning.
<br /> be sold to Mr. C. Ac Rawlings for the sum of $50.00.

<br /> Section 2e That the title to Said property described in Section 1 hereof,
<br />shall be conveyed to Mr. Co A, Rawlings by deed prepared by the Director of Law;
<br />that the City of Lakewood shall furnish the PurChaser a limited warranty deed,
<br />which shall disclose the title to said property to be free and clear of all liens
<br />or encumbrances, except restrictions of record, Zoning Ordinance of the City of
<br />Lakewood and except the taxes and assessments for the year 1952, if any, and
<br />thereafter; that taxes and assessments, if any, shall be pro-rated as of the date
<br />of filing the deed for record; that the sale of said property shall be subject
<br />to the approval of the Mayor-Director of Public Works, and that the Mayor and
<br />Director of Finance are hereby authorized to convey such property by limited
<br />warranty deed to ~Mr. C~ A. Rawlings, subject to the foregoing conditions.

<br /> Section 3. That this ordinance is hereby declared to be an emergency
<br />measure for the reasons stated in the preamble hereof and provided it receives
<br />
