<br /> I <br /> \ <br /> ORDINANCE NO. 101-58 BY: Messrs. Fahrenbach, Fairgrieve, <br /> Gaydos, Gottermeyer, <br /> Lawther, Ward, Chockley. <br />AN ORDINANCE to amend Section 961.04 of the General Offenses <br />Code of the Codified Ordinances of the City of Lakewood, relative to <br />library books. <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br />Section 1. That Section 96~.04 of the General Offenses Code of <br />the Codified Ordinances of the City of LakeWGod, now reading: <br />"961.04 Library books, misuse; penalty. <br />Whoever wilfully or negligently detains Or fails to return to <br />any public library any book, maga~ine, pamphlet, manuscript, <br />picture, clipping or other property belonging to such public <br />library within thirty (30) days from the date of the posting <br />by registered mail of a notice addressed to such person at the <br />last address furnished the public library and which notice may <br />be given at any time after the date on which such person should <br />have returned the loaned property in accordance with the rules <br />of such public library, shall be presumed to have converted <br />the same to his own use, and shall be guilty of a misdemeanor <br />and be fined in a sum not less than one dollar ($1.00) and not <br />exceeding twenty-five dollars (425.00); provided, however, <br />that no penalty shall be imposed in any case where restitu- <br />tion in value shall have been made prior to the expiration of <br />said thirty (30) day period, nor in any case where the return <br />of such book, pamphlet, manuscript, picture, clipping or <br />other property has been rendered impossible by causes beyond <br />the control of the borrower." <br />shall be and is hereby amended to read as follows: <br />961.04 Library books, misuse; penalty. <br />Whoever wilfully or negligently detains or fails to return to <br />any public library any book, maga~ine, pamphlet, manuscript, <br />picture, clipping or other property belonging to such library, <br />or pay the reasonable value thereof, within thirty (30) days <br />from the date of the posting by certified mail of a notice <br />addressed to such person at the last address furnished the <br />public library and which notice may be given at any time after <br />the date on which such person should have returned the loaned <br />property, shall be guilty of a misdemeanor and be fined not <br />more than twenty-five dollars (,25.00). <br />Section 2. That this ordinance shall take effect and be in <br />force at the earliest period allowed by law, and original Section <br />961.04 of the General Offenses Code of the Codified Ordinances of the <br />City of Lakewood shall be and it is hereby repealed¡ <br />Adopted: December 15. 1958 Thomas C.
