COUNTY OF LAKEWQOD, THE CITY BE IT ORDAINED BY THE COUNCIL OF OF CUYAHOGA. STATE OF OHIOf Section 1. That it 1S hereby determined to proceed with the improvement of Arthur Avenue from Detroit Avenue to Hilliard Road by resurfacing same with asphaltic ,oncrete and doing any or all grading, draining and curbing or other work necessary thereto, in accordance with Resolution No. )66;, adopted May 5, 1956 and in accordance with plans, specifications, estimates and profile. heretofore approved and now on file in the office ot the Director of Public Works. Section 2. That all claim. tor damages resulting from sid im- provement shall be judicially inquired into after the completion thereof and that the Director ot Public Works be and he is hereby authorized and directed to enter into contract tor said improvement in the manner provided by law, which improvement in accordance with Article 14, Section 16 of the Charter has been estimated by the Director of Public Works to have a life of five (5) years. Section). That £or the purpose of paying the cost and expense of said improvement there is hereby levied and assessed a special assessment upon the several lots and parcels of land designated in and in accordance with the estimated assessment (No. 733), as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments and aggregating not to exceed $12,003.95. Said estimated assessment is hereby determined to have been made on the basis of special benefits conferred by said improvement on the several parcels of land therein described and the same 1s herein confirmed, adopted and approved. Said lots and land assessed are all the lota and land bounding and abutting upon the improvement of Arthur Avenue from Detroit Avenue to Hilliard Road. Section 4. That the owners of the several lots or parcels of land included in said assessment shall pay the amounts from them severally due as shown by Column 13 of said estimated assessment No. 7J3 to the City Treasurer on or before thirty days from the date of the passage of the ordinance, at their option# and in default thereof said special assessment with interest at the rate of three per centum per annum upon deferred payments shall be payable to the County Treasurer in annual installments, with the regular taxes of 1959 to 1963, both inclusive. Section 5. That said annual payments of said assessments andall portions thereof and interest thereon shall be applied to the payment of bonds to be issued in anticipation of the collection thereof and the interest thereon as the same shall become due and to no other purpose whatsoever.
