STATE OF OHIOf <br /> <br />Section 1. That it 1S hereby determined to proceed with the <br />improvement of Arthur Avenue from Detroit Avenue to Hilliard Road by <br />resurfacing same with asphaltic ,oncrete and doing any or all grading, <br />draining and curbing or other work necessary thereto, in accordance <br />with Resolution No. )66;, adopted May 5, 1956 and in accordance with <br />plans, specifications, estimates and profile. heretofore approved and <br />now on file in the office ot the Director of Public Works. <br /> <br />Section 2. That all claim. tor damages resulting from sid im- <br />provement shall be judicially inquired into after the completion <br />thereof and that the Director ot Public Works be and he is hereby <br />authorized and directed to enter into contract tor said improvement <br />in the manner provided by law, which improvement in accordance with <br />Article 14, Section 16 of the Charter has been estimated by the Director <br />of Public Works to have a life of five (5) years. <br /> <br />Section). That £or the purpose of paying the cost and expense <br />of said improvement there is hereby levied and assessed a special <br />assessment upon the several lots and parcels of land designated in <br />and in accordance with the estimated assessment (No. 733), as made <br />for that purpose by the Director of Finance and recommended to this <br />Council by the Board of Revision of Assessments and aggregating not <br />to exceed $12,003.95. Said estimated assessment is hereby determined <br />to have been made on the basis of special benefits conferred by said <br />improvement on the several parcels of land therein described and the <br />same 1s herein confirmed, adopted and approved. Said lots and land <br />assessed are all the lota and land bounding and abutting upon the <br />improvement of Arthur Avenue from Detroit Avenue to Hilliard Road. <br /> <br />Section 4. That the owners of the several lots or parcels of <br />land included in said assessment shall pay the amounts from them <br />severally due as shown by Column 13 of said estimated assessment <br />No. 7J3 to the City Treasurer on or before thirty days from the date <br />of the passage of the ordinance, at their option# and in default thereof <br />said special assessment with interest at the rate of three per centum <br />per annum upon deferred payments shall be payable to the County Treasurer <br />in annual installments, with the regular taxes of 1959 to 1963, both <br />inclusive. <br /> <br />Section 5. That said annual payments of said assessments andall <br />portions thereof and interest thereon shall be applied to the payment <br />of bonds to be issued in anticipation of the collection thereof and <br />the interest thereon as the same shall become due and to no other <br />purpose whatsoever. <br />
