':1'hat it is hereby determined to proceed with the im- provement of Lauderdale Avenue from Ðetroit Avenue to Madison Avenue by resur£acing same with asphaltic concrete and doing any or all grad- ing, draining and curbing or other work necessary thereto, in accord- ance with Resolution No. )871, adopted May S, 1958 and in accordance with plans, specifications, estimates and profiles heretofore approved and now on file in the office of the Director of Public Works. BE IT ORDAINED BY CUYAHOGA, STATE OF OHIO I Section 2. '!'hat all claims tor damages resulting from said im- provement shall be judicially inquired into after the completion thereof and that the Director of Public Works be and he is hereby authorized and directed to enter into contract for said improvement in the manner provided by law, which improvement in accordance with Article 14, Section 16 of the Charter ~.as been estimated bY the Director of Public Works to have. lite of five (5) years. Section 3. That tor the purpose of paying the cost and expense of said improvement there is hereby levied and assessed a special assessment upon the several lots and parcels of land designated in and in accordance with the estimated assessment (No. 737), as made for that purpose by the Director of Finance and recommended to this Council by the Board of Revision of Assessments and aggregating not to exceed $20,258.82. Said estimated assessment is hereby determined to have been made on the basis of special benefits conferred by said improve- ment on the several parcels of land therein described and the same is herein confirmed, adopted and approved. Said lots and land assessed are all the lots and land bounding and abutting upon the improvement of Lauderdale Avenue from Detroit Avenue to Madison Avenue. Section 4. That the owners of the several lots or parcels of land included in said assessment shall pay the amounts from them severally due as shown by Column'3 otsaid estimated assessment No. 73~ to the City Treasurer on or before thirty days from the date of the passage of the ordinance, at their option, and in default thereof said special assessment with interest at the rate of three per centum per annum upon deferred payments shall be payable to the County Treasurer in annual installments, with the regular taxes of 1959 to 1963,both inclu- sive. Section 5. That said annual payments of said assessments and all portions thereof and interest thereon shall be applied to the payment of bonds to be issued in anticipation of the collection thereof and the interest thereon as the same shall become due and to no other pur- pose whatsoever.
