Copy ORDINANCE NO. 46-58 BY: Messrs. Ward, Chockley, Fahrenbach, Fairgrieve, Gaydos, Gottermeyer AN E~RGENCY ORDINANCE authorizing the payment of the sum of $16,656.40 to The Kalill Co. for repairs to a sewer on Halstead Avenue. WHEREAS, On or about June 2, 1958, a portion of the sanitary sewer in Halstead Avenue collapsed, and WHEREAS, Immediate attention thereto was mandatory, and WHEREAS, The exigencies of the situation demanded ~hat a sewer contractor be immediately hired for the purpose of repairing such sewer, and WHEREAS, A delay, which of necessity would have been occasioned by compliance with the statutory bidding requirements, would have been dangerous to the health and safety of the citizens of Lakewood, and WHEREAS, This ordinance constitutes an emergency in that it provides for the immediate preservation of the public peace, property, health or safety and provides for the usual daily operation of a municipal department, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That payment be made to The Kalill Co. in the amount of $16,656.40 for the repairing of a sewer in Halstead Avenue. Section 2. That the Director of Finance be and he is hereby directed to pay the sum of $16,656.40 to The Kalill Co. for repairs to the sewer on Halstead Avenue, and that the said sum be charged to the Sewer Construction and Improvement Fund. Section 3. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hersof, and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
