ORDINANCE NO. 47-58 BY: Messrs. Ward, Chockley, Fahrenbach, Fairgrieve, Gaydos, Gottermeyer. AN EMERGENCY ORDINANCE determining to proceed with the construc- tion of a sewer in Grace Avenue, between Detroit and Madison Avenues. WHEREAS, Article V, Section 3 of the Charter of the City of Lakewood requires that COuncil shall by ordinance determine whether public improvements shall be made by direct employment of labor and the purchase of the necessary supplies and material, or by contract, and WHEREAS, Upon consideration thereof, this Council determines it to be in the best interests of the City of Lakewood to construct a sewer in Grace Avenue, between Detroit and Madison Avenues, by con- tract rather than by direct employment of labor and the purchase of supplies and material, and WHEREAS, This Council considers it in the interests of the City of Lakewood that the Contract be entered into at the earliest poss- ible time, and designates this ordinance as necessary for the immedi- ate preservation of the public peace, property, health or safety, now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1, That Council determines that the construction of a sewer in Grace Avenue, between Detroit and Madison Avenues, shall be done by the department of public works by contract rather than by the direct employment of labor and the purchase of the necessary sup- plies and material. Section 2. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof, and provided i~ receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
