Lawther, Chockley, <br /> Fahrenbach, Fairgrieve, <br /> Gaydos, ~ottermeyer. <br /> <br /> AN ORDINANCE to regulate the use and to prevent the abuse of <br />sidewalks and curbing in the City of imkewood, and repealing Ordinance <br />No. &059, adopted Mmy ~, 19~2, and all other ordinances or parts of <br />ordinances inconsistent herewith. <br /> <br />OHIO: <br /> <br />BE IT ORDAINED BY ~{E COUNCIL OF ."IiE CITY OF LAKEWOOD, STATE OF <br /> <br /> Section 1. That for the purpose of this ordinance, a sidewalk <br />shall be understood to be that portion of a street between the curb <br />lines, or the lateral lines of a roadway, and the adjacent property lines' <br />intended for the use of pedestrians. <br /> <br /> Section 2. No person shall break, deface, damage or destroy any <br />sidewalks or curbing in or along the streets or public places of the <br />City of Lakewood. <br /> <br /> Section 3. That before any person other than a city contractor, <br />officer, or employee, shall make any opening or remove any sidewalk or <br />curb in or along any of the streets, alleys, avenues or public grounds <br />in the City of Lakewood, such person shall file with the Director of <br />Public Works a written or printed application for a permit, setting <br />forth and indicating thereon the location and extent of the opening in <br />the sidewalk or curb desired to be opened up or removed, and the purpose <br />and size of the opening to be made. Before any permit is granted, the <br />applicant shall pay to the City of Lakewood adePosit of fifty dollars <br />($50.00), after which payment the Director of Public ~orks may issue a <br />permit, and the applicant may proceed to do the work. The foregoing. <br />shall not apply to sidewalk taken up to lay connections by persons <br />duly authorized and required to make house connections, and to relay and <br />replace pavements under their contract. ~hen any opening has been made <br />as herein provided, the same shall he carefully refilled, and when the <br />sidewalk is restored to its proper condition, the person procuring the <br />permit shall so certify to the Director of Public Works and, upon the <br />report of the chief inspector, the Director of Public Works shall refund <br />to him the amount of his deposit less ten dollars ($10.00) thereof to be <br />retained as cost of inspection. In the event the chief inspector does <br />not report the work done to conform to the original condition, then the <br />City shall have the work done at the applicant's expense. <br /> <br /> Section ~. Any person violating any of the provisions ~f this <br />ordinance, shall, upon conviction thereof, be fined in any sum not to <br />exceed fifty dollars ($50.00) and the costs of prosecution. <br /> <br /> Section 5. That this ordinance shall take effect and be in force <br />at the earliest period allowed by law, and at such time Ordinance No. <br />~059, adopted ~J~y $, 1952, and all other ordinances or parts of ordinances <br />inconsistent herewith shall be and are hereby repealed. <br /> <br />Adopted:.
