<br /> AN EMERGENCY ORDINANCE authorizing the ~ayor, as Director ef
<br />Public Works, to enter ints an agreement with the Beard ef Park Commis-
<br />sioners of the Cleveland Metropolitan Park District relative te the
<br />sale ef Scenic Park.
<br />
<br /> ~EREAS, The constrmctien efa bridge in the se-called Scenic
<br />Park area has long been delayed and the City ef Lakewood and the Board
<br />of Park Commissioners sf the Cleveland Netropelitan Park District have
<br />new reached am agreement for the constrmetion of smch bridge and the
<br />conveyance of the lands hereimaf~er described ts the Park Board, and
<br />
<br /> WHEREAS, The execution of this agreement will enable the Park
<br />Beard te commence construction ef the said bridge daring the year ef
<br />19~9, and
<br />
<br /> WHEREAS~ Delay ef the completion ef this a~reememt will psst-
<br />pone construction of smeh bridge mmtil the year 1960, and
<br />
<br /> WHEREAS, The eonstrmetion ef smch bridge is necessary for the
<br />immediate preservation e£ the public peace, property, health er safety,
<br />new, therefore,

<br />BE IT ORDAINED BY THE CO~¢IL OF THE CITY OF L~WOOD, STATE OF
<br />
<br /> Section 1. That the Mayor, as Director ef Public Works, be and
<br />he is hereby authorized te enter into an agreement with the Board ef
<br />Park Commissioners ef the Cleveland Metropolitan Park District, sub-
<br />stantially as follows:

<br /> That, whereas, the parties hereto did en the 14th day of April,
<br />1~24, enter imte au agreement whereby Lakewoed grante~ te the Park
<br />Beard the right to develop, improve and protect the preper~y therein
<br />referred to as "Limceln Park", the "Mathews and Gilbert property" and
<br />the "H. J. H'unting~en property", which lands are also known as "Scenic
<br />Park", owned by Lakewood, in connection with adjacent lands owned ~y
<br />and ~nder the control ef the Park Board, er to ~e acqmired by the Park
<br />Hoard, which land is a part of the se-calledRocky River Reservation ef
<br />the Cleveland Metropolitan Park System, and
<br />
<br /> Whereas, said agreement provided that the Park Board wo~d grade,
<br />drain, eenstrmct an8 maintain the park roadway from Detroit Avenue near
<br />the easterly approach of the Rocky River bridge and into the Reeky River
<br />valley, all ef which the Park Beard has done, and said agreement farther
<br />provided that the Park Beard wemld construct a s~ta~le bridge across
<br />Rocky River in the line ef the park drive near the existing sewage
<br />disposal plant of Lake,Need, and
<br />
<br /> Whereas, the Park Board desires te acquire the fee title ~o
<br />lands ewmed by the City of Lakewood and mere rally described hereinafter
<br />as an integral part ef the Rocky River Reservation of the Park System,
<br />in order te place the control and development of said lands on a more
<br />permanent basis amd for the p~pese of censtrmcting the said bridge
<br />across Reeky River, and
