ORDINANCE NO. 25-59 BY: Messrs. Fahrenbaeh, Gaydos, Lawther, Ward, Checkley. AN EMERGENCY 0RDINANCE authorizing the Hayer, on behalf of the City of Lakewoed, Ohio, to.enter into an agreement with the Director of Highways ef the State of Ohio, for theimprovement of Lake Avenue within the City of Lakewood. ~REAS, The Director of Highways is considering improving a portion of the public highway which is described as follows: The improvement of U.S. 6 DA~O~O©), locally know~ as Lake Avenme, by removing part of the existing asphaltic sur- face and resmrfacing the existing pavement from cmrb te Cmrb, on all of U.S. 6 DA which lies within the corporate limits of the City of Lakeweod, being in all a distance of about 2.98 mi. No Right of Way required. ~HEREAS, This ordinance is declared te be an emergency for the reason that the condition of smch read is such as to inconvenience, endanger and delay pnblic travel thereon, and that smch road reqmires immediate improvement thereof; for the reason aforesaid, it is nec- essary to proceed forthwith in order to complete the improvement of said road during the present year, and for the reason that it provides for the maintenance ef the public property, health and safety and the usual daily operatiem of a municipal department, new, therefore, BE IT ORDAINED BY THE CO~CIL OF THE CITY OF LAKE~OD, STATE OF OHIO: Section 1. That it is de¢lare~ te be in the p~hlic interest that the consent ef said city be and snch consent is hereby given te the Director ef Highways te construct the above described improvement, in acoerdamce with plams, specifications and estimates as prepared ~y said Director. Section 2. That said City hereby proposes to cooperate with the State of Ohio, in the cost of the above described improvement, ~y a~s~ming and contributing fifty.percent (50%) of the cost of construc- tion, plms ome h~dred percent (100%) of thecost of all materials and labor necessary to rearrange and adjust to the new grade, all water mains, service lines, fire hydrants, valve boxes, sanita~% sewers or other municipally-ewaed utilities and/or appurtenances there- to necessary to conform t~ said improvement, i~clusive of the cost ef engimeerimg, contingencies and ether incidental expenses, estimated at $70,000.00. Section 3. That the Mayor of said City is hereby amthorized enter into maintenance and parking agreements and special contrac- tmal obligations. Section ~. That it is hereby agreed that said City will, after completion ef the aforementioned project, maintain the improve- ment herein contemplated in accerdamce with the provisions ef the statutes relating thereto and will make ample financial and other pro- visions for such maintenance, and maintain the right ef way and keep it free ef obstructions in a manner satisfactory to the State of Ohio. Section 5. That upon completion of said improvement, said City will thereafter a) Keep said highway open to traffic at all times; and b) Regmlate parking in the following manner:
