Section 731.49 of Chapter 31 . <br />ef the Traffic Code of the Codified Ordinances of the City of Lakewoo~, <br />defining and prohibiting drag racing. <br /> <br /> k~EREAS, This ordinance constitutes an emergency in that it <br />provides for the immediate preservation ef the public peace, property, <br />health and safety~ new, therefore, ~ <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That Section 731.$9 of the Traffic Code of the <br />Codified Ordinances of the City of Lakewood be enacted as follows: <br /> <br />Section 731.49 Defining and prohibiting drag racing. <br /> <br />(A) Drag racing is the operation of two or more vehicles <br />from a point side by side at accelerating speeds in a <br />competitive~ttempt to out-distancE ~ach other Or the <br />operation of one or more vehicles over a common selected <br />course, from the same point to the same point, wherein <br />timing is made of the participating vehicles involving <br />competitive accelerations or speeds, Persons rendering <br />assistance in any manner to such competitive use of ve- <br />hicles shall be equally charged as the participants. The <br />operation oftwo or mere vehicles sfde by side either at <br />speeds in excess oF prima facie lawful.speeds established <br />by paragraphs (3), (4) and (5) of Sectzon 731.05 ef the <br />Traffic Code of the Codified Ordinances of the City ef <br />Lakewood or rapidly accelerating from a common starting <br />point te a speed in excess of such prima facie lawful <br />speeds shall be prima facie evidence of drag racing. <br /> <br />(B) No person shall participate in a drag race as defined <br />in division la) of this section upon any public road, <br />street, or highway within the City of Lakewood. <br /> <br />(C) Whoever violates the provisions of this sectio~ shall <br />be fined not more than five hundred dollars or imprisoned <br />not more than six months or both. <br /> <br /> Section 2. This ordinance is hereby declared to.be an emergency <br />measure for the reasons stated in the preamble hereof, and provided <br />it receives the affirmative vote of two-thirds ef all members elected <br />to Council, it shall take effect and be in force immediately upon <br />its adoption and approval by the Mayor. <br /> <br />Adopted: Decembe.r 2!, 1959 <br /> <br />Thomas C.
