WHEREAS~ this C*~ncil by twomthirds vote of the members elected thereto determines that this ordinance is au e~ergency ~asure which is necessary for the immediate preservation of the F~blic peace, property, health and safety and for the further reason that the improvements herein provided are i~mediately necessary to eliminate existing hazards to vehi~mlar traffic uSing the streets of this ¢ity$ N0~ THEREFORE~ ~ IT ORDAINE~ by the City of Lakewood~ Cu~ahoga County, State of Ohio, three-fourths of all members elected thereto concurring: Section 1o That it is hereby determined to proceed with,~the improvement of Winton Avenue frc~ Cordova Avenue to Nadison Avenue° Section 2o Such improvement shall be made by the necessary grading of the base, resurfacing with asphaltic concrete including the necessary replacement and setti~ of castings and the necessary resetting and replacing of curbs together with necessary-appurtenances thereto ~ud in accordance withResolution No. 4411 l~ssed on the 15th day of March, 1965, aud in accordance with th~ plans, specifications estimates and profiles heretofore approved and now on file in the office of the Director of Public Works; the character of the m~terials te be bid upon for the resurfacing is~ asphaltic concrete and for the curbs is s~one or concrete as sho~n on the plans, and reference is made to said plans and ~specifications for additional information concerning the character of the materials for such improvem~nto Section 3. That the Board of Revision of Assessments has reported to this Council that no claims for damages resulting frc~ the improvement have been filed~ but if it should be determined that any claims have been fiIed~ they shall be in~ ~ired into before the c~encement of the proposed improvement, and the Director of Law shall he, and he' is hereby authorized and directed to institute legal proceedings in a cottrt ~f competent Jurisdiction to in%~tire into a~y claims so filed. Section 4,, That not more than 50% of the whole cost of said improvement shall be assessed by the benefits upon the following described lots a~ ~auds, to wit: All lots and lands bounding and abutting upon the proposed improven~nt between the termini aforesaid, which said lets and lands are hereby determined to be speciality benefited by said improvement; aud the cost of' said improvement shall include the cost of preliminary and other surveys~ plans~ specifications, profiles and estimates and of printing~ serving and publishing notices~ resolu~ tions and ordinances, the amount of damages res~lting from the improvement assessed in favor of a~y ~ner of l~ud affected by the improvement and the Lu- retest thereon~ the costs incurred in co~a~ection with the prep~r~tion~ levy and collection of the special assessments, th~ co~t of ~ch~ing~ ~ppropriating.
