Wendling, Bem~ett, <br /> Cain, Gaydos, <br /> Huffman, Ward. <br /> <br /> AN EMERGENCY ORDINANCE to provide for payment from the General <br />Fund of the City of Lakewood to widows of deceased policemen and <br />firemen of the City of Lakewood having children under the age of <br />sixteen years, which widows and/or children are otherwise qualified <br />to receive payment from the Police Relief and Pension Fund or Fire- <br />men's Relief and Pension Fund, in any month in which the appropriate <br />Fund is unable to pay the monthly benefit due. <br /> <br /> WHEREAS, This ordinance constitutes an emergency measure pro- <br />viding for the preservation of public property, health and safety <br />and to provide for the usual daily operation of a municipal de- <br />partment, and, <br /> <br /> WHEREAS, The Police Relief and Pension Fund and the Firemen's <br />Relief and Pension Fund of the City are, from time to time, unable <br />to pay all current benefits due the respective beneficiaries there- <br />of by reason of insufficient funds, and, <br /> <br /> WHEREAS, It has come to the attention of this Council that <br />there are presently two (2) widows with minor children under the <br />age of sixteen years who are entitled to receive monthly benefits <br />from said Funds and that a hardship results from failure to re- <br />ceive benefits promptly, and, <br /> <br /> WHEREAS, This Council deems it to be in the best interest of <br />the City to alleviate this hardship~ now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF CHI0: <br /> <br /> Section 1. That in any month in which the Police Relief and <br />Pension Fund or the Firemen's Relief and Pension Fund is unable to <br />pay monthly benefits to its beneficiaries, the Finance Director of <br />the City of Lakewood be, and he is hereby authorized to pay from <br />the General Fund, to widows of deceased policemen and firemen of <br />the City having children under the age of sixteen (16) years, which <br />widows and/or children are otherwise qualified and entitled to re- <br />ceive monthly benefits from the Police Relief and Pension Fund or <br />Firemen's Relief and Pension Fund, such sum or sums of money equal <br />to the monthly benefit they would normally receive. Provided, how- <br />ever, that such payments shall cease in the event such widow shall <br />be remarried or in the event the youngest child of the deceased <br />fireman or policeman attains the age of sixteen years, whichever <br />event occurs first. <br /> <br /> Section 2. That such payment from the City shall be in lieu <br />of payment from the Police Relief and Pension Fund or the Firemen's <br />Relief and Pension Fund and shall be made by the Finance Director <br />on the 1st day of the month following the month for which no pay- <br />ment has been received by such widow or as soon thereafter as is <br />practicable. Such widow, upon receipt of payment by the City, shall <br />execute a receipt therefor together with a waiver of any claim she <br />might have against the appropriate Fund for said amount and an in- <br />demnification agreement in regard to any portion of said payment <br />she may receive hereunder on behalf of the minor children. Upon <br />disbursement to said widow and children, the Finance Director shall <br />promptly notify the appropriate Relief and Pension Fund. <br /> <br /> <br />
