ORDINANCE NO. 56-65 BY:Messrs. Usher, Ward, Wendling, Bennett, Cain, Gaydos, R~ffman. AN EMERGENCY ORDINANCE authorizing settlement of the claim of Ail American Insurance Company, as subrogee of one Gordon Stewart, in the total amount of Two Hundred Seventy and 54/100 Dollars ($270.54), arising out of an accident involv- ing a snow plow belonging to the City of Lakewood and the automobile of Mro Stewart, on March 10, 1964. WHEREAS, This ordinance constitutes an emergency in that it may save the city from further expense and possible litigation in that it provides for the immediate settlement of said claim and in that it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1o That settlement of the claim of Ail American Insurance Company, in the amount of Two Hundred and Seventy Dollars and fifty-four cents ($270.54), is hereby ordered and authorized, conditioned upon the execution and delivery by Ail American Insurance Company of a full release in favor of the City of Lakewood, duly approved by the Director of Law. Section 2o That the Director of Finance be and he is hereby authorized to pay the sum of Two Hundred and Seventy Dollars and fifty-four cents ($270~54) to All American Insurance Company, upon delivery to the Director of Finance of the fore- going release duly executed and approved; and to charge the same to the General Fund - Damages Paid by the City. Section 3o That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two- thirds of all members elected to Eouncil, it shall take effect and be in force immediately upon its adoption and approval by the Mayor° Adopted: June 21, 1965 John Gaydos, Jr. 'President Approved:JUne 28' ~965 .... ,Mary Adams Clerk Robert M.
