ORDINANCE NO. 44-66 BY: Messrs Gaydos, Huffman, Kelley, Usher, Ward AN ~ERGENCY ORDINANCE authorizing the Mayor, on behalf of the City of Lakewood, to purchase the certain parcel of real estate located at 1460 Marlowe Avenue in the City of Lakewood, hereinafter more particularly described. WHEREAS, This ordinance constitutes an emergency measure in that the owner has agreed to sell said property for the consideration hereinafter stipulated, which this Council deems to be in the best interest of the City and in that it provides for the public health and welfare and for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor be and he is hereby auth- orized to purchase, on behalf of the city of Lakewood, from the owner thereof, the following described parcel of property: .1460 Marlowe Avenue Owner: Dolores R. Duggan Situated in the City of Lakewood, County of Cuyahoga and State of Ohio, and known as being all of Sub Lot No. 232 and the Southerly t foot of Sub Lot No. 233 in the Genck Realty Company's Lakewood Subdivision, as shown by the recorded plat in Volume 35 of Maps, Page 26 of Cuyahoga County Records, together forming a parcel of land 46.0 feet front on the Westerly side of M~rlowe Avenue, and extending back 119.625 feet on the Northerly line, 130.30 feet on the Southerly line, and having a rear line of 46.0 feet, as appears by said plat, be the same more or less, but subject to all legal highways.. and to pay therefore the following sum of money to the owner: Dolores R. Duggan $ 25,300.00 Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be prorated as of the date of transfer; that the Director of Finance be and he is hereby authorized to pay the amount set forth in Section 1 hereof from the Hospital Improvement Fund upon delivery by the grantor of the Warranty Deed, together with release of dower, if any, to the City of Lakewood, together with guarantee of title disclosing the said real estate to be free and cIear of all encumbrances, excepting taxes and assessments not yet due and payable, zoning ordinances and restrictions of record, if any; and that the Director of Finance be and he is hereby authorized to pay the costs in~ident~ al to the completion of the purchase of said real estate, includ ing the cost of recording the deed and one-half of the escrow agent's fee from said fund.
