ORDINANCE NO. 44-66 BY: <br /> <br />Messrs <br /> <br /> Gaydos, <br />Huffman, Kelley, <br />Usher, Ward <br /> <br /> AN ~ERGENCY ORDINANCE authorizing the Mayor, on <br />behalf of the City of Lakewood, to purchase the certain parcel <br />of real estate located at 1460 Marlowe Avenue in the City of <br />Lakewood, hereinafter more particularly described. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure in that the owner has agreed to sell said property for <br />the consideration hereinafter stipulated, which this Council <br />deems to be in the best interest of the City and in that it <br />provides for the public health and welfare and for the usual <br />daily operation of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor be and he is hereby auth- <br />orized to purchase, on behalf of the city of Lakewood, from the <br />owner thereof, the following described parcel of property: <br /> <br />.1460 Marlowe Avenue <br />Owner: Dolores R. Duggan <br /> <br />Situated in the City of Lakewood, County of Cuyahoga <br />and State of Ohio, and known as being all of Sub Lot <br />No. 232 and the Southerly t foot of Sub Lot No. 233 <br />in the Genck Realty Company's Lakewood Subdivision, <br />as shown by the recorded plat in Volume 35 of Maps, <br />Page 26 of Cuyahoga County Records, together forming <br />a parcel of land 46.0 feet front on the Westerly side <br />of M~rlowe Avenue, and extending back 119.625 feet on <br />the Northerly line, 130.30 feet on the Southerly line, <br />and having a rear line of 46.0 feet, as appears by <br />said plat, be the same more or less, but subject to <br />all legal highways.. <br /> <br />and to pay therefore the following sum of money to <br />the owner: <br /> <br />Dolores R. Duggan <br /> <br />$ 25,300.00 <br /> <br /> Section 2. That the title to said property shall be <br />subject to the approval of the Director of Law; that taxes and <br />assessments shall be prorated as of the date of transfer; that <br />the Director of Finance be and he is hereby authorized to pay <br />the amount set forth in Section 1 hereof from the Hospital <br />Improvement Fund upon delivery by the grantor of the Warranty <br />Deed, together with release of dower, if any, to the City of <br />Lakewood, together with guarantee of title disclosing the said <br />real estate to be free and cIear of all encumbrances, excepting <br />taxes and assessments not yet due and payable, zoning ordinances <br />and restrictions of record, if any; and that the Director of <br />Finance be and he is hereby authorized to pay the costs in~ident~ <br />al to the completion of the purchase of said real estate, includ <br />ing the cost of recording the deed and one-half of the escrow <br />agent's fee from said fund. <br /> <br /> <br />
