Kelley, Usher, Ward, <br /> Wendling, Cain, Gaydos~ <br /> Huffman <br /> <br /> AH EI~ERGE~JCY ORDINANCE authorizing <br />of the claim of Nicholas Onk, sro, in the total amounh <br />one Hundred Forty-Three Dollars and Sixteen Cents ($143o16), <br />arising out of an accident at Lakewood Hospital on May <br />1960. <br /> <br /> ~P~AS, This ordinance constitutes an emergency <br />in that it may save the city from further expense and a possible <br />substantial jury verdict rendered against the City and in that <br />it provides for the usual daily operation, of a municipal de- <br />partment; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF ~IE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1o That settlement of the claim of <br />Nicholas Onk, Sr. in the amount of $t43°16 is hereby ordered <br />and authorized, conditioned upon the execution and delivery by <br />Nicholas Onk, Sr. of a full re, ease in favor of the City of <br />Lakewood and Lakewood Hospital Foundation, Inc., duly approved <br />by the Director of Law and a dismissal with prejudice of <br />cause number 7461~8 now pending in Cuyahoga County Common Pleas <br />Court. <br /> <br /> Section 2. That the Director of Finance be and he <br />is hereby authorized to pay =he sum of $143.16 to Nicholas Onk, <br />Sr., upon delivery to the Director of Finance of the foregoing <br />release duly executed and approved!and to charge the same to <br />the General Fund - Damages Paid by City. <br /> <br /> Section 3. That this ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the pre- <br />amble hereof and provided it receives the affirmative vote of <br />two-thirds of all members elected to Council it shall take <br />effect and be in force immediately upon its adoption and <br />approval by the Mayor. <br /> <br />Adopted~ September 19,. 19.66 <br /> <br />......
