Huf~fma~, Kelley, Usher, Warn, Wendling AN~ME~GEmCY~OR~INANCE ~rizing the Mayor, behalf of the City of Lakewood, to purchase the certain real estate loeat~d at 1459 Belle Avenue in the City of Lakewood, hereinafter more particularly described. on WHEREAS, This ordinance constitutes an emergency measure in that the owners have agreed to sell said property for the consideration hereinafter stipulated which this Council deems to be in the best interest of the City and in that it provides for the public health and welfare and for the usual daily operation of a municil~al department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section t. That the Mayor be, and he is hereby aue-horized to purchase from Eva M. Fowler and from the Executor of the Estate of Ambrose E. Fowler, the following described property, together with Release of Dower, if any: Situated in the City of Lakewood, County of Cuyahoga, and State of Ohio and known as being Sublot No. 123 in the Belle Avenue Allotment of part of Original Rockport Township Section No.22, as shown by the recorded plat in Volume 41 of Maps, 'Page 23 of Cuyahoga County Records, and being 45 feet front on the Easterly side of Belle Avenue, 187 93/100 feet deep on the Northerly line, 187 83/100 feet deep in the Southerly line, and 45 feet in the rear, as appears by said plat, be the same more or less, but subject to all legal highways. and to pay therefor the sum of Twenty-Two Thousand Dollars ($22,000.00). Section 2. That the title to said property shall be subject to the approval of the Director of Law; that taxes and assessments shall be pro-rated as of the date of transfer~ that the Director of Finance~,~e, and he is hereby authorized to pay the amount set forth in Section 1 hereof from the Hospital Expansion Fund upon delivery by the Grantors of the Warranty Deed and the Executor's Deed, together with Release of Dower, if any, to the City of Lakewood, together with Guaranty of Title-disclosing the said real estate to be free and clear of all encumbrances, excepting taxes and assessments not yet due and payable, zoning ordinances and restrictions of record, if any; and that the Director of Finance be and he is hereby authorized to pay the costs inciden- tal to the completion of the purchase of said real estate, including the cost of recording the Deed and one-half of the escrow agent's fee from said fund. Section 3. This ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor.
