ORDINANCE NO. 8-67 BY: MessrS. Cain, Gaydos, <br /> Huffman~ Kelley, Usher, <br /> Ward, Wendling <br /> AN EMERGENCY ORDINANCE to enact new Section <br />965.25 of the General offenses Code of the Codified Ordinances <br />of the City of Lakewood relating tOabandoned refrigerators. <br /> <br /> WHEREAS, This ordinance constitutes an emergency <br />measure providing for the immediate preservation of the public <br />health, safety, and welfare and for the usual daily operation <br />of a municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the General Offenses Code of the <br />Codified Ordinances of the City of Lakewood be and the same is <br />hereby supplemented by enacting a new Section 967°25 to read as <br />follows: <br /> Section 967.25 Abandoned Refrigerators <br /> <br /> No person shall abandon, discard, orknowingly permit <br /> to remain on premises under his control, in a place <br /> accessible to children, any abandoned or discarded <br /> icebox, refrigerator, or other airtight or semi- <br /> airtight container which has a capacity of one and <br /> one-half cubic feet or more and an opening of fifty <br /> square inches or more and which has a door or lid <br /> equipped with hinge, latch or other fastening device <br /> capable of securing such door or lid, without rendering <br /> such equipment harmless to human life by removing such <br /> hinges, latches or other hardware which may cause a <br /> person to be confined therein. This section shall not <br /> apply to an icebox, refrigerator or other airtight or <br /> semi-airtight container located in that part of a <br /> building occupied by a dealer, warehouseman or repair- <br /> man engaged in the business of selling, storing, or <br /> repairing such iceboxes, refrigerators, or other airtight <br /> or semi-airtight containers. <br /> <br /> Whoever violates this section shall be fined not less <br /> than twenty-five ($25.00) nor more than two hundred <br /> dollars ($200.00). <br /> <br /> Section 2.
